Prison labor is every US Corporation's dream: cheap labor, no sick leave, no time off, no holidays and employees that can be easily replaced. For human rights activists however, it's a nightmare for the very same reasons - but on the other side of the coin: forced labor, no unions, low pay and no protection for employees. The US has used or currently uses prison labor for anything from holiday coffee for Starbucks, cutting airplane components for Boeing, Game Boys for Nintendo, equipment for the war in Iraq, shrink wrapping mousses for Microsoft, making dentures, down to sewing lingerie for Victoria's Secrets. It's a multi-billion dollar business. Today, FSRN brings you an exclusive documentary, Prison Labor, Made in the U.S.A., with reporter Karen Miller.

Support the Good Time Bill and Push for Change in the Federal Prison System!

Americans inside US federal prisons have had no prospect of early release for decades thanks to the Sentencing Reform Act of 1984, which abolished federal parole. Since the early 1980’s federal prisons have become increasingly crowded. No provision has been made to decrease the burden to the federal prison system and the expense to the American taxpayer, and there is no incentive for prisoners to work towards changing their behavior while they are incarcerated – no amount of rehabilitation or good behavior will, under the current rules, bring any of the over 200,000 people in the federal system home to be reunited with loved ones and community.

The estimated yearly cost to house one prisoner in the federal system is over $40,000, and lengthy incarcerations are an increasing drain on the health of the US economy. The Federal Bureau of Prisons is more than forty percent over capacity, and prison overcrowding presents real dangers to prisoners as well as staff. Some facilities are one hundred percent above capacity, and there is no plan to relieve the strain on the system. The vast majority of people held in federal prisons are non-violent low-level drug offenders with very long sentences, and there is significant over-representation of people of color – forty percent of inmates are African-American and sixteen percent are Mexican citizens. Do we want to continue to dump money into an overburdened, dysfunctional federal system, or do we want to give people a second chance to be part of our communities?

A bill about to be re-introduced to Congress would reduce the sentences of people in federal prisons by increasing the "good time" credit all federal prisoners receive. This would apply to all federal prisoners except the ones serving life sentences. Re-establishing good time credit would save US tax-payers more than 2 billion dollars per year. Representative Danny Davis of Illinois introduced H.R. 7089 – the Federal Prison Work Incentive Act of 2008 – in the last session of Congress, and it is expected to be introduced again when Congress reconvenes. There is a good chance this bill will pass if it becomes a priority on the congressional agenda. Making this bill a priority for Congress will require a concerted push from all corners of the prison reform, political prisoner support, and progressive social justice communities nationwide.

WHAT YOU CAN DO TO SUPPORT THE “GOOD TIME” BILL
* Write, call, and email you Congressional Representatives! Urge them to reintroduce and then vote for this bill. You can find out who your Congressional Representative is at www.house.gov or http://www.visi.com/juan/congress/index.html by typing in your address and zip code. If you write, write them at the local (not DC) address. Calling is easy and effective. You’ll speak to an aid briefly and they’ll take down your name and your position. The bill is currently in the Judiciary Committee of the House of Representatives. If you have a representative on this committee (http://judiciary.house.gov/about/members.html), urge them to vote it out of committee and support it. In your letter, let your representative know if you know and care about a federal prisoner but you can also bring up crowding issues and the economic drain federal prisons are on the health of the country. Urge him to sign the amended Executive agreements which will allow NY
inmates Herman Bell (#2318931) and Jalil Muntaqim (s/n Anthony Bottom/
#2311826) to return to New York State to attend their rightful parole
hearings. We're calling him every Wednesday morning of '08 until he signs
off on the transfer.

The transfer of SF8 defendants Herman Bell and Jalil Muntaqim from the San
Francisco County Jail back to New York State for their rightful parole
hearings has been blocked by both state governors for weeks and NYS now
wants to deny this right for good. This comes despite previous agreements
in the courtroom between the California State prosecutors, the presiding
judge and, of course, the brothers and their attorneys.

Judge Philip Moscone signed an order in May allowing Herman Bell and Jalil
Muntaqim to return to New York State for their parole hearings. All
parties agreed at that time that the move would be temporary; Herman and
Jalil waived their rights to fight extradition back to California.

"Angola 3" Member to Be
Released On Bail After 37 Years

Conviction Overturned, Judge Rules Albert Woodfox Must be Free During Appeals or Re-trial

Lawyers: Ruling Brings Hope for Remaining Prisoner, Also Spent 36 Years in Solitary for Guard's Murder

Albert Woodfox, who has spent 37 years in prison at Angola Penitentiary, must be released on bail, according to a ruling issued today by United States District Judge James Brady. On September 25th, Judge Brady overturned Woodfox's conviction for the 1972 murder of prison guard Brent Miller. Though the State has announced its intention to appeal that decision, until such an appeal is successful, according to today's ruling, there is no conviction on which to hold Woodfox.

In his decision, Judge Brady wrote:
"[Woodfox] is a frail, sickly, middle aged man who has had an exemplary conduct record for over the last twenty years. At the hearing before this Court on October 14, 2008, testimony was adduced that if released Mr. Woodfox would live with his niece and her family in a gated subdivision in Slidell, Louisiana. Mr. Woodfox has withdrawn that request because of fear of harm to his niece and her family by members... This change was brought about by counsel representing the State of Louisiana contacting the subdivision home owners association and providing them with information regarding Mr. Woodfox. The Court is not totally privy to what information was given to the association but from the documents filed it is apparent that the association was not told Mr. Woodfox is frail, sickly, and has had a clean conduct record for more than twenty years…this Court GRANTS Mr. Woodfox's motion for release pending the State's appeal."

Herman Wallace, who was also convicted in the murder, remains in prison at Angola. He has an appeal pending with the Supreme Court of Louisiana, which is similar in content to Woodfox's successful appeal. The two men were wrongly convicted based largely on the testimony of a fellow prisoner, Hezekiah Brown, a serial rapist who was promised and received a pardon in exchange for his testimony against them. Brown was the sole professed eyewitness to the murder, and none of the physical evidence put Herman or Albert at the crime scene.

Woodfox's legal team is now working with the court to reach an agreement on a suitable release location and plan for Woodfox; once they agree to a plan, Woodfox will be able to leave Angola. The lawyers anticipate the process to take several more days.

Woodfox and Wallace were each held in solitary confinement from the time of the murder until last March, after a federal court concluded that their suit alleging that such confinement for three decades constitutes cruel and unusual punishment could go forward. A third man, Robert King Wilkerson, was held in solitary at Angola at the same time for a different crime; he was released in 2001 after showing that he had been wrongfully convicted. The three are known as the "Angola 3." All black men, they had been organizing nonviolently for an end to gang-enforced sex slavery and for better conditions inside the prison. Angola at the time was known as the "bloodiest prison in the US."

"This is a major victory in a case where justice is long overdue. Albert went into Angola in his twenties, and he's walking out in his 60s. There is no conviction against him now, and the state should not take another day of his life," said Chris Aberle, Woodfox's lawyer.

"In 37 years, Albert never gave up hope that someday he would walk out the gates of Angola. We continue to hope that Herman will join him soon. Neither of these men should have spent a day in Angola for this crime," said Nick Trenticosta, also a lawyer in the case.

The case has attracted attention on the state and national level. Last spring, US House Judiciary Committee Chair John Conyers (D-MI) visited the men, along with Louisiana House Judiciary Committee Chair Cedric Richmond (D-101). Richmond has announced his intention to hold hearings on the case, and Conyers continues to monitor developments.

The state had sought a stay of Judge Brady's ruling ordering a new trial until the appeal process plays out. Judge Brady granted that request. The State must now either win its appeals, or will need to either release or retry Woodfox within 120 days of the end of its appeals.

Judge Brady held an initial bail hearing on October 14th; he postponed issuing a decision at that time to allow for additional depositions to be taken from Angola Warden Burl Cain and from a doctor who had examined Woodfox and his medical records. The State has now conducted both of those depositions.

A German court has approved the release from jail of a leader of a radical leftist group involved in high-profile killings in the 1970s and 1980s.

Red Army Faction leader Christian Klar, aged 56, is serving five life terms but will have served the minimum required 26 years by January.

The court in Stuttgart said there were no grounds to keep him in custody.

The group, also known as the Baader-Meinhof gang, targeted bankers, businessmen, judges and US servicemen.

More than 30 people were killed by the gang, before it disbanded 10 years ago.

"A major consideration was the question of whether it could be feared that Christian Klar would commit significant criminal acts again," but the judges decided there was no evidence he would, the court said in a statement.

It said that Klar would remain on probation for five years after his release.

Klar was arrested in 1982 and later convicted of nine murders and 11 attempted murders.

It is the brutality of the Red Army Faction's crimes which shocked the public, the BBC's Steve Rosenberg in Berlin says.

Along with the principal targets of their terror, bodyguards and drivers were gunned down.

In one case, the head of a bank was assassinated at his home, after being presented with a bunch of flowers by the killers.

Swedish Eco-defence prisoner

ELP recently learnt that last month a 20-year old Swedish man was arrested
and remanded accused of eco-sabotage activity.

The police claim, that at the time of his arrest, the 20-year old man from
Älmhult had in his possession a number of items including guides on how to
make incendiary devices.

ELP understands that the 20-year old was, last week, indicted as a suspect
in an eco-sabotage investigation and is accused of four acts of criminal
damage, which includes damaging a radio tower, sabotaging a construction
site and damaging a vehicle used in the timber industry. The man was also
investigated for an arson against a newly built villa, but no charges have
been bought against him in that investigation due to there being no evidence
against him what so ever.

At this moment in time ELP has no further information on this man. We do
not know him name, we do not know where he is being held, and we do not know
how to get any messages of support to him.

If you know anything about this case; if you know of any other suspects; if
you are friends with the 20-year old man and can help set up a support
campaign for him so people can write letters of support to him; please get
in contact with ELP as soon as possible. The 20-year old man has already
spent at least a month in prison without any international support. Lets
try and get some support to him before another month goes by!

Hunger strike ends as Greek government caves

After 18 days 7,000 prisoners in greece stop their hunger strike after the ministry of justice concedes to a series of their demands, promising to release half the country's prison population by April 2009.

On Thursday the 20th of November more than 7,000 hunger strikers in greek prisons demanding a comprehensive 45-point program of prison reform have decided to stop their hunger strike, already on its 18th day, after the Ministry of Justice responded to their struggle and to the widening solidarity movement which in the last weeks has held several mass protest marches in the greek cities by declaring that by next April the number of prisoners in greek jails will be reduced to 6.815 from the present 12.315, thus effectively releasing half of the country's prison population.

The Ministry's declaration in detail states that:

1) All persons convicted to a sentence up to five years for any
offense including drug related crimes can tranform their sentence into
a monetary penalty. This will not be allowed in the case the jury
decides that the payment is not enough to deter the convict from
commiting punishable acts in the future.

2) The minimum sum for tranforming one day of prison sentence to
monetary penanlty is reduced from 10 euros to 3, with the provision of
being reduced to 1 euro by decision of the jury.

3) All people who have served 1/5 of their prison sentence for 2
year sentences and 1/3 for sentences longer than 2 years are to be
released, with no exceptions.

4) The minimum limit of served sentence is reduced to 3/5 for
conditional release and for convicts for drug related crimes. Those
condemned under conditions of law ?. 3459/2006 (articles 23 ??? 23?)
are excepmpted.

5) The maximum limit of pre-trial impironment is reduced from 18 to
12 months, with the excemption of crimes puniched by liife or 20year
sentence.

6) The annual time of days-off prison is increased by one day.
Tougher conditions for days-off are limited for those convicted for
drug related crimes under ?. 3459/2006.

7) Disciplinary penalties are to be integrated.

8) Integration after 4 years into national law of the European Council decision of drug trafficking (2004/757).

9) Expansion of implementation of conditional release of convicts
suffering from AIDS, kidney failure, persistent TB, and tetraplegics.

What the Ministry failed to answer with regard to the prisoners' demands include:

1) Monetary exchange of prison sentences longer than 5 years,
especially for 6.700 prisoners presently convicted for non-criminal
offenses.

2) Abolition of juvenile prisons

3) Abolition of accumulative disciplinary penalties

4) Abolition of 18 months pre-trial imprisonment for a large number of offenses.

5) Satisfactory expansion of days off, despite the fact that the
application of present liberties has been tested as succesfull during
the last 18 years.

6) Immediate improvement of relocation conditions of convicts

7) Holding a meeting between the minister of justice and the prisoners' committee

Thus in a press release, the Prisoners' Commitee announced that:

"The amendment submitted to the Parliament by the Ministry of
Justice tackles but a few of our demands. The minister ought to
materialize his promises for the immediate release of the suggested
number of prisoners announced, and at the same time implement concrete
measures regarding the totality of our demands. We the prisoners treat
this amendment as a first step, a result of our struggle and of the
solidarity shown by society. Yet it fails to covers us, it fails to
solve our problems. With our struggle, we have first of all fought for
our dignity. And this dignity we cannot offer as a present to no
minister, to no screw. We shall tolerate no arbitrary acts, no vengeful
relocation, no terrorizing disciplinary act. We are standing and we
shall stay standing. We demand form the Parliament to move towards a
complete abolition of the limit of 4/5 of served sentence, the
abolition of accumulated time for disciplinary penalties, and the
expansion of beneficial arrangements regarding days-off, and
conditional releases for all categories of prisoners. Moreover, we
demand the immediate legislation on the presently vague promises of the
minister of justice regarding the improvement of prison conditions
(abolition of juvenile prisons, foundation of therapeutic centers for
drug dependents, implementation of social labour in exchange for prison
sentence, upgrading of hospital care of prisoners, incorporation of
european legislation favorable to the prisoners in the greek law etc.).
Finally, we offer our thanks to the solidarity movement, to every
component, party, medium, and militant who stood by us with all and any
means of his or her choice, and we declare that our struggle against
these human refuse dumps and for the victory of all our demands
continues".

"Friday, Nov.14, at 11h in the morning we distributed 200 A4-size leaflets in front and around the building of the Economy and Comerce Section of the Greek Embassy, in the center of Lisbon, leaving some of them inside the building also. The leaflets included a small introdutory text to the prisoners' struggle, a few of their demands, and a chronology of the events until that day. Besides, it also included the following text:

"Prison is everywhere, in all our life. Constantly we are watched, controlled, identified, listened... it is the cop, the surveillance camera, the court, the judge, the police station, and our entire reality of forced interactions... it is the fear of being what we are, of saying what we feel, of doing what we would like to do... it is the everyday misery, it stalks us in our memory, it is a permanent threat...

Prison is also that isolate building, where only the convicted and the hangmen are... it is the siege from where we can not leave, it is the guards that control and torture us, it is our body in the hands of the state...it is the walls that enclose and hide us, that push us away for years... it is the place where everything is taken away from us...

Prison is, at the same time, an idea and a building. But always a reality.

In Greece, like everywhere else, the struggle of the prisoners is the only way to face and fight the reality to which they are forced. To accept prison is only possible due to all the means of alienation the state uses, inside and outside the prisons, and that create a daily life of fear and resignation. What's happening today in the Greek prisons has born from the determination of individuals kidnapped by the state, and although we are outside the walls, that doesn't mean we're free. That freedom, we have to conquer it.

In Greece, in Portugal, and anywhere else, no condition of life inside a prison will ever be human, because that's impossible inside a prison. There's no reform of whatever nature that can, in any way, humanize this place where we're locked up; where everything, with the exception of dignity, is taken away from us.

But dignity will always belong to those who struggle, to the insurgents, to the individuals.

There are countless ways with which to show our solidarity and spread the revolt, attacking control and the controllers of this world; the first step is to decide on which side we are.

Having said this, the only "demand" we have is the destruction of every prison and of this prison-society!

Russia: Solidarity with Moscow anti-fascist prisoner Aleksey Olesinov!

On the 18th of November, an action against repression of anti-fascists will take place at Metro Station "Novokucnetskaya" in Moscow. Action will begin 16:00, and will demand freedom for anti-fascist prisoner Aleksey Olesinov. Aleksey is imprisoned for more than 10 days already, and has been held incommunicado by authorities, his lawyer Stanislav Markelov has still not been allowed to meet with him. Health condition and conditions in which he is kept are not known to his relatives and friends. Friends of Olesinov are certain, that he is persecuted due to participation to anti-fascist activities.

Aleksei Olesinov was arrested 6th of November, and accused of "hooliganism", according to statue 213,
second part of Russian criminal codex. Although he has never before faced
criminal charges, he was remanded. Police motivated the decision to remand him
with the fact that Olesinov is an anti-fascist activist.

Formal pretext for arrest is an insignificant fight which took place
30th of August between visitors of one of the Moscow clubs and security
of the club. Nobody was wounded during the fight, Olesinov was arrested
the same night close to the club, but eventually police who arrested him
did not pressed even misdemeanor charges against him.

For unclear reason case of Olesinov is united with two felony
investigations. Another of them is the murder case of anti-fascist
activist Fyodor Filatov. It is possible, that police attempts to hide
fact that investigation is doing nowhere by arresting one of the
activists of the anti-fascist movement.

Case of Olesinov is under personal control of first vice-minister of
internal affairs M.I.Suhodolskiy. It is rather unlikely, than an average
case of "hooliganism" is under a personal control of first vice-minister
of internal affairs.

Currently Olesinov is kept in remand prison of "Butyrka", but he was in
a police prison for 6 days, which is a reason to believe that police
tortured him there in order to gain information on workings of
anti-fascist movement.

Participators of the anti-fascist movement demand to stop violations of
legal rights of Aleksey Olesinova, to give him an access to lawyer, and
also to stop using murder of Fyodor Filatov to purposes which have
nothing to do whatsoever with the murder investigation.

Cheney, Gonzales Indicted in Texas Prisoner Abuse Case

A South Texas grand jury has indicted Vice President Dick Cheney and former Attorney General Alberto Gonzales on state charges related to the alleged abuse of prisoners in Willacy County's federal detention centers.

The indictment, which had not yet been signed by the presiding judge, was one of seven released Tuesday in a county that has been a source of bizarre legal and political battles in recent years. Another of the indictments named a state senator on charges of profiting from his position.

Willacy County District Attorney Juan Angel Guerra himself had been under indictment for more than a year and half before a judge dismissed the indictments last month. This flurry of charges came in the twilight of Guerra's tenure, which ends this year after nearly two decades in office. He lost convincingly in a Democratic primary in March.

Cheney's indictment on a charge of engaging in an organized criminal activity criticizes the vice president's investment in the Vanguard Group, which holds interests in the private prison companies running the federal detention centers. It accuses Cheney of a conflict of interest and "at least misdemeanor assaults" on detainees because of his link to the prison companies.

Megan Mitchell, a spokeswoman for Cheney, declined to comment on Tuesday, saying that the vice president had not yet received a copy of the indictment.

The indictment accuses Gonzales of using his position while in office to stop an investigation in 2006 into abuses at one of the privately run prisons.

Gonzalez's attorney, George Terwilliger III, said in a written statement, "This is obviously a bogus charge on its face, as any good prosecutor can recognize. Hopefully, competent Texas authorities will take steps to reign in this abuse of the criminal justice system."

Willacy County has become a prison hub with county, state and federal lockups. Guerra has gone after the prison-politician nexus before, extracting guilty pleas from three former Willacy and Webb county commissioners after investigating bribery related to federal prison contacts.

Another indictment released Tuesday accuses state Sen. Eddie Lucio Jr. of profiting from his public office by accepting honoraria from prison management companies. Guerra announced his intention to investigate Lucio's prison consulting early last year.

Lucio's attorney, Michael Cowen, released a scathing statement accusing Guerra of settling political scores in his final weeks in office.

"Senator Lucio is completely innocent and has done nothing wrong," Cowen said, adding that he would file a motion to quash the indictment this week.

Last month, a Willacy County grand jury indicted The GEO Group, a Florida private prison company, on a murder charge in the death of a prisoner days before his release. The three-count indictment alleged The GEO Group allowed other inmates to beat Gregorio de la Rosa Jr. to death with padlocks stuffed into socks. The death happened in 2001 at the Raymondville facility, just four days before de la Rosa's scheduled release.

In 2006, a jury ordered the company to pay de la Rosa's family $47.5 million in a civil judgment. The Cheney-Gonzalez indictment makes reference to the de la Rosa case.

None of the indictments released Tuesday had been signed by Presiding Judge Manuel Banales of the Fifth Administrative Judicial Region.

A second batch of indictments targeted public officials connected to Guerra's own legal battles.

Willacy County Clerk Gilbert Lozano, District Judges Janet Leal and Migdalia Lopez, and special prosecutors Mervyn Mosbacker Jr. -- a former U.S. Attorney -- and Gustavo Garza -- a longtime political opponent of Guerra -- were all indicted on charges of official abuse of official capacity and official oppression.

Garza, the only one who could be immediately reached Tuesday, called it a sad state of affairs.

"I feel sorry for all of the good people this unprofessional prosecutor has maligned," Garza said. "I'm not at all concerned about the accusations he has trumped up."

Banales dismissed indictments against Guerra last month that charged him with extorting money from a bail bond company and using his office for personal business. An appeals court had earlier ruled that Garza was improperly appointed as special prosecutor to investigate Guerra.

After Guerra's office was raided as part of the investigation early last year, he camped outside the courthouse in a borrowed camper with a horse, three goats and a rooster. He threatened to dismiss hundreds of cases because he believed local law enforcement had aided the investigation against him.

On Tuesday, Guerra said the indictments speak for themselves. He said the prison-related charges are a national issue and experts from across the country testified to the grand jury. Asked about the indictments against local players in the justice system who had pursued him, Guerra said, "the grand jury is the one that made those decisions, not me."

The transfer of SF8 defendants Herman Bell and Jalil Muntaqim from the SanFrancisco County Jail back to New York State for their rightful parolehearings has been blocked by both state governors for weeks and NYS nowwants to deny this right for good. This comes despite previous agreementsin the courtroom between the California State prosecutors, the presidingjudge and, of course, the brothers and their attorneys.

Judge Philip Moscone signed an order in May allowing Herman Bell and JalilMuntaqim to return to New York State for their parole hearings. Allparties agreed at that time that the move would be temporary; Herman andJalil waived their rights to fight extradition back to California. Thisvindictive and mean-spirited procedural obstacle was immediatelychallenged by defense attorneys. Strong arguments were made to guarantee Herman and Jalil's right to "pursue their liberty interests" and haveparole hearings. Both have served over 35 years in prison as modelprisoners. Both were targeted originally by COINTELPRO as members of theBlack Panther Party.
New York Attorney Bob Boyle argued in a declaration to the San FranciscoCourt that if the men remain in California, "they would be denied theirparole hearing for years." In a subsequent interview, he also said: Thestate waited 35 years to bring these spurious criminal charges. Now thesecharges are being used to deny these men parole hearings to which they areentitled. Whatever concerns the government has can be overcome by a simplemodification of the extradition order. All Herman and Jalil are asking foris an opportunity to attend their hearings.

Eight former Black community activists – Black Panthers and others – werearrested January 23rd in California, New York and Florida on chargesrelated to the 1971 killing of a San Francisco police officer. Similarcharges were thrown out after it was revealed that police used torture toextract confessions when some of these same men were arrested in NewOrleans in 1973.

Richard Brown, Richard O'Neal, Ray Boudreaux, and Hank Jones were arrestedin California. Francisco Torres was arrested in Queens, New York. HaroldTaylor was arrested in Florida. Two men charged – Herman Bell and JalilMuntaqim – have been held as political prisoners for over 30 years in NewYork State prisons. A ninth man -- Ronald Stanley Bridgeforth – is stillbeing sought. The men were charged with the murder of Sgt. John Young andconspiracy that encompasses numerous acts between 1968 and 1973.

Harold Taylor and John Bowman (recently deceased) as well as Ruben Scott(thought to be a government witness) were first charged in 1975. But ajudge tossed out the charges, finding that Taylor and his twoco-defendants made statements after police in New Orleans tortured themfor several days employing electric shock, cattle prods, beatings, sensorydeprivation, plastic bags and hot, wet blankets for asphyxiation. Such"evidence" is neither credible nor legal.

Herman Bell, 59, of Mississippi, a political prisoner since 1973.Cointelpro's "pattern of manipulation and lies, continuing into thepresent, indicates something more than the ordinary corruption and racismof everyday law enforcement. It can be understood only in terms of thepower of the political movement that [we] were part of, and the intensityof the government's efforts to destroy that movement and to disillusionand intimidate future generations of young activists." Anarchist Art Space Raided in LA

LAPD suppresses radical art space

Imagine a place where people can come together to exchange
ideas, create art, play music, and otherwise invest in a better
world, starting here and now in Los Angeles. Some LA heads went
beyond imagining and created it. After many hours of hard work and
planning, they finally opened it up to the community to host a hip
hop show, a benefit for next month's anarchist bookfair. The crowd
was mostly young people from a variety of backgrounds and different
parts of the city. Some of us were painting and organizing for the
first Los Angeles Really Really Free Market, but mostly people were
just bobbing their heads to the beats. We were obviously a threat to
the system and the American way of life.

I was inside when all I hear are loud thumps, and then people
yelling. Some people started spreading the word that the cops were
out there trying to break in. It was right about that time I started
hearing the helicopter overhead. We closed the door and started
organizing. "They can't come in here without a warrant. You have the
right to remain silent--and everybody should." Nonetheless there was
some confusion. It seems like someone decided that they needed to
inform the cops that we knew our rights and refused to be
intimidated. They went outside, and people closer to the door said
that they were getting searched.

There was some harassment going on at the door and the cops started
coming in. Some people started finding other ways out, but most of us
just stood our ground. The cops were trying to convince us all to
come out. But mostly we just stayed there. Finally they convinced a
trusted member of the community that if we didn't all come out with
our hands on top of our heads that we were all going to be arrested.
Everyone that was still inside filed out with our hands atop our
heads and were lined up facing the fence across the alley from the
spot.

There were about 12 cop cars lining the alley and the adjacent
street. My guess is that there were about 60, maybe 75 of us lined
up. I counted 24 cops, and then a couple of bicycle units showed up.
And the bird was still on the wing, spotlighting us and our spot.
One-by-one, they patted us down. People with bags had them searched.
Once they were sure we weren't armed or doped up (they didn't find
anything on anyone) they sent us to face the wall a little further
down the alley. The one who searched asked me what was going on in
the warehouse. "Just a little hip hop," I said. Meanwhile, the cops
are realizing not everyone filed out obediently and some people are
on the roof of another warehouse. They started yelling at them from
the chopper to get down. Our friends smiled and waved.

The cops didn't seem to know what to do in the face of resistance,
and kept ordering us to keep out hands on our heads, keep quiet, and
keep facing the fence. Eventually they let us put our hands down.
After a while, a sergeant identified himself and ordered us to turn
around and face him. He said that one of us had been accused of
shoplifting and that someone was going to inspect us and identify the
thief.

Slowly, a cruiser cruised by, shining bright-ass lights in our faces.
Some people said they thought they saw a camera in there. When they
got to the end of the line, they stopped and started coming back.
They pulled a guy out of line. He looked to be in his early 20s,
Latino, with long hair, dressed pretty metal. They searched him and
took him away.

Some people in the line-up got mad at that guy, buying the pig line
and blaming him for burning the spot. As if someone shoplifting, if
he really did it, was justification of the cops' gross violations of
our rights.

Then the cops pulled two more people, a man and a woman from the
Black Riders, out of the line and took them away. Then they demanded
to speak with the owner of the warehouse, or failing that, the
organizer of the party. "Somebody needs to step up, or..." the cops
threatened. How might things have worked out differently if we all
would've taken one step forward? But only one compañero did. The
sergeant talked to him and about four cops surrounded him. They
talked peaceably for a few minutes, and I heard the pig asking if he
had the keys so he could lock the building up. Then I see them
handcuffing him and taking him away. They didn't say what he was
being charged with.

Next they separated the people who needed to go back in to get
something of theirs, and the cops started taking them in three at a
time. Then they freed everyone who had come by bicycle.
They asked us where we parked, and we all said "around the corner"
and pointed around the corner. Then they let half of us go. Walking
down the alley I could see some of the compañerxs in the cop cars and
still being harassed. And when I got to the street, I saw cops on
foot beside the cars parked there, writing on notepads. They weren't
writing tickets, just writing. "Damn they're getting our plates."
Needless to say, everyone was pissed off and very concerned for our
arrested comrades. And there was the inevitable questioning and
fingerpointing. "Didn't that guy who was here earlier seem a little
suspicious? Is there an informant?"

Well, part of the problem is that we had no real security measures to
speak of. Maybe we didn't feel like we needed them, because
everything we're doing is totally legal. But, knowing the LAPD, and
the general political scene, we should know better.
They're sending a message loud and clear: We know who you are, we
will harass and try to intimidate you, threaten you with criminal
prosecution on trumped-up charges, use force against you, for daring
to associate yourself with the movement. Because right now something
special is going on. There has been anarchism in LA for a long time,
but now we are finally seeing people crossing boundaries, working
together, creating alternatives, creating community, and attracting
crowds of people to peacefully support those same ideas.
We need to remain strong, not believe any pig bullshit that is trying
to drive wedges between us, and strengthen our ties to each other.
The only solution to this problem is community.

Police Raid of Anarchist Event

Last night the at the Revolutionary Autonomous Communities
fundraiser for the Anarchist Bookfair at the food not bombs warehouse
on 6th and Santa Fe was raided by the LAPD. They kicked open the door
and unlawfully entered in to the private space.

Joaquin Cienfuegos, a member of RAC and Copwatch LA Guerrilla chapter
was targeted by the police and pulled out from the space. When folks
inside the space heard what was going on in front they went over to
observe and document what was going on. Joaquin asked why he was
being detained and they told him to "Shut up" and "Do as he's told".
He was handcuffed and searched without his permission. While he was
being searched Joaquin stated loud and clear that he did not consent
to their search and once again asked to please be told why he was
being detained.

While i was at the door way observing what they were doing to the
comrade outside i could see the the street was blocked off and there
were about 12 police cars on 6th street and about 30 or more
Deputies/Depupigs. As we tried to get cameras to document what was
going on the police rushed the door again and i was pulled outside by
4 police officers. They pushed me against the wall and made me place
my hands on top of my head and searched me. I asked the Officer why i
was being detained and he said, "A crime had been committed a few
blocks away and they were going to bring the victim to identify the
person."

As i was pulled out, the folks inside closed the door to prevent the
rush of pigs into the property. They began to kick the door and yell
at the folks inside to get out. Not once did they announce themselves
as the Police Department or why they were there or wanted folks to
exit the show. Police officers were outside making joke;" Do you
smell that? i think its weed, we should go inside and find out", and
"This is some kind of illegal rave or show or what do we call it?".
Clearly unable to choose a reason why they were trying to raid the
space they made up whatever we want.

After i had been searched, a female officer came over and i asked
once again why i was being detained. She stated that this was an
illegal gathering and they wanted to figure it all out. Officers were
walking all over the front in very confused manner having to be told
by other officers to move out of the way. I could see the shadows on the officers behind
me and Joaquin who continued to hold their hands on their weapons
while we were handcuffed with our hands behind our backs.

After the police ignored the request by the owner of the space to
present a search warrant or leave the private property, the comrades
from the Black Liberation Party that were there in part to perform
for the fundraiser exited the building and were immediately detained
and sister Nadia and Kambui were placed in handcuffs and the rest of
the the Black Riders where made to face the wall. The police then
rushed inside and pulled everyone out. They had us right in front of
the space and then made me walk down the blocked as they lined
everyone up against the wall. They pull more than 60 people out from
the space and had them with their hands against their back facing the
wall. They separted the women from the men and began to search
everyone.

A police officer that searched me came and asked for my ID. They said
they were going to check me for warrants or any priors. He pulled out
my ID and pulled out a card that he began to fill in with all my
personal information. I asked what that card was for but i was not
given an answer. My ID was returned but the card with my information
was kept by them.

After they searched everyone's belongings they lined up all the males
and females and said that this was going to be a line-up and they
were going to bring the the victim of the crime to identify the
perpetrator. When asked what crime (had been committed) an officer
told another brother that they had had a crime committed a few blocks away and some beer
was stolen from a liquor store. When asked why so many officers where
there for stolen beer the officer said, "He didnt know", that they
just felt that whoever committed the crime was in the space.
A police helicopter was circling and made the announcement after
everyone was removed that they were the LAPD. 2 folks from Food Not
Bombs who were in the premise were pulled out and placed in handcuffs.
A police car with 2 Officers in the front and a woman in the back
seat drove by slowly. The officers proceeded to tell people to look
into the light and not look at the car. Everyone said they couldn't
look at the light because it hurt their eyes but the officers from
inside continued to shine the light into people's eyes. As this was
going on, officers continued to line up and make jokes about
"overtime" and the way different folks were dressed. For one officer
in particular he lamented his rookie friend, "was off tonight because
he would have loved to have been a part of this!" As the police car
made its way down the street they stopped and singled out one youth .
He was immediately arrested. They drove back again slowly and
continued to point the light in people's face. My handcuffs were
removed but i was not allowed to leave. i was made to remain facing
the fence with my hands behind my back.

After a police officer from some other car came with a pience of
paper and pointed to Nadia and Kambui from the black Riders
Liberation Part and said they were being detained for "148"-
interfering with a police officer. When people asked why they were
being detained or singled out police officers told them to shut up.
They placed them both in cuffs and removed all their belongings and
put them into plastic bags. They were then placed into the backseat
of a police car.

Another police officer came and then annonced that the party was over
and people needed to leave. People still had equipment inside and
were made to line up and escorted inside to get thier belongings.
While inside i noticed that money from the fundraiser was missing and
according to folks inside the money was there before the police ran
inside to pull everyone out. We got out all the groups' equipment and
waited for someone to come close the space. They continued to harass
people and tried to intimidate many of the youth to leave and to
learn their lesson. Besides the one youth that was arrested for
supposedly stealing beer, everyone was arrested for interfering with
a police officer when all they asked was why they were being detained.
The officers were congragulating themselves and laughing at everyone.
Many of the officers were staring down many of the sisters that were
there and making sexist jokes about he'd rather be home with his wife
than here. Then he proceeded to make a hand gesture to 2 sisters who
were standing near by. No one but the other officers were amused by
these pigs but they continued to talk shit and tell people to leave.
The majority officers left smiling and staring at folks in attempts
to instigate some incident to lead to further arrest.

While we were waiting the final officer drove by and rolled down his
window. He stated" Im sorry we had to shut down your party but you
have to keep the youngsters in check and can't be letting them go
anywhere stealing beer. If they hadn't stolen the beer we wouldnt
have canceled your show"

Everyone was pissed as this provacateur behavior which is being
utilized as the excuse to enter into private property and raid a
peaceful gathering. The police looked for whatever excuse to shut the
show down.

Joaquin is currently being held for misdemeanor . He has not been
taken to jail and is still being held by Central Division. He will
probably be going to court tomorrow or Wednesday. Please spread the

Food Not Bombs folks to get out.

This is a quick report trying to include as many of the important
details as possible but i'm sure i might have overlooked other
important details from last night that other folks who were also
there can maybe share and i will try and write more about last night
later tonight and will follow up with more details.

Community Solidarity with Oly 26

Supporters of the Oly 26 gathered in Sylvester Park in Downtown Olympia today to protest the Thurston County prosecutor’s decision to press charges against the Oly 26. The Oly 26 are 25 women and one man charged for their participation in the November 2007 Port of Olympia anti-war protests. Audio Photos

Women gave speeches from the gazebo making connections between various forms of oppression including war and violence to women. A focus was also on women's participation in war resistance and the struggle to end war shipments locally.

The march went down 4th Ave and then to the gates of the Port of Olympia. People talked briefly of their experiences there before heading to the port plaza. People from the Oly 26 spoke about their experiences.

Prison terms devastate Myanmar democracy movement

BANGKOK, Thailand (AP)– In a devastating week for Myanmar's democracy movement, dozens of its members have been sentenced to lengthy prison terms, as the military-ruled government locks away writers and Buddhist monks — as well as musicians, a poet and at least one journalist.

By the weekend, more than 80 had received sentences of up to 65 years — a move that seemed designed to keep them jailed long past upcoming elections, activists and analysts said Sunday.

"They are clearing the decks of anyone who is likely to challenge their
authority ahead of the election" in 2010, Larry Jagan, a Bangkok-based
newspaper columnist and Myanmar analyst, said of the generals who rule
the country.

Many of those sentenced were arrested following mass pro-democracy protests that were crushed by the ruling junta in September 2007. According to U.N. estimates, at least 31 people were killed and thousands were detained. Many fled the country or went
underground.

Others sentenced this week were arrested in 2007 for protesting a massive fuel-price hike —
demonstrations that preceded the protests in September. The blogger
received more than 20 years in prison for Internet activities,
and a poet was sentenced to two years for allegedly concealing the text
of an anti-government slogan in one of his works. The journalist was
arrested while covering a demonstration staged by victims of this
year's devastating cyclone.

News of the sentences came mostly through activists and analysts. The military junta
that has ruled Myanmar since 1962 did not comment on the sentences,
most of which were handed down in closed-door proceedings. It was not
known why the prisoners were sentenced now, although many analysts
concluded the move was made to eliminate opposition ahead of the
election that the junta has described as part of its "roadmap to
democracy." Opposition groups and other critics dismiss it as a sham
meant to perpetuate military rule.

"Now they won't be able to participate in the election," said Soe Aung,
spokesman for the National Council for the Union of Burma, a
Thailand-based umbrella organization for exile groups. "The generals
are trying to put the final nail in the coffin to keep themselves in
power forever."

Twenty-three of those sentenced were members of the 88 Generation Students group, veterans of a brutally suppressed 1988 democratic uprising, who received prison
terms of 65 years each, and a labor activist, Su Su Nway,
was sentenced to 12 1/2 years. At least 10 people allied with the
pro-democracy National League for Democracy party headed by Nobel Peace
Prize laureate Aung San Suu Kyi received jail terms of eight to 24 years.

"They fear the 88 Generation Students. They were at the forefront of the
protest last year, and they are not passive," Jagan said.

Early Sunday, nine of the more prominent members of the 88 Generation Students group were taken from infamous Insein Prison in a Yangon suburb to prisons in more remote parts of the country, according to Aung Din, co-founder of the Washington-based U.S. Campaign for Burma, which lobbies for political change in Myanmar, also called Burma.

"The transfer of political prisoners to far-flung districts is an additional punishment to the activists and such a move will cause extreme social and financial burden to the families," said Nyan Win, spokesman for the National League for Democracy party.

The European Union said last week that the election will be seen as illegitimate unless the junta frees all political prisoners.

Amnesty International and other human rights groups say the junta holds more than 2,100 political prisoners, up sharply from nearly 1,200 in June 2007, before the pro-democracy demonstrations.

The prisoners include opposition leader Suu Kyi, who has spent more than 13 of the past 19 years under house arrest.

Good news from around the world!

ELP has some great news from around the world!
First off, the three Animal Rights activists, jailed in Stockholm accused of criminal damage to a fur shop have been released from prison following their trial today. The three do not know the verdict of their trial yet and will find that out on the 28th of November. As soon as ELP has a verdict we will let you know.
Secondly, ELP has been told that the two Tasmanians arrested for anti-logging activity at the end of last month are due in court next week but they are not expecting any prison sentences.
Of course all this on top of the news that despite being found guilty at the end of her trial, Giana Rodrigues Gomes from Spain was sentenced to three years imprisonment but instantly released due to time served on remand. Her co-defendant Ugio Caamanho Sam-Tisso, was also found guilty and senteced to just under five years imprisonment (far less than the 21 years the prosecution wanted). Due to his time served on remand Ugio is expected to be released in the next few months. However in the mean time please continue to send letters of support to:

French Anarchists Charged With Rail Sabotage

Don't look now, but here comes Europe's violent extreme-left again. Two decades after French police busted the radical group Action Directe, which waged a bloody urban guerrilla war during the 1970s and 1980s against French business and military interests, French authorities on Tuesday nabbed a group of anarchists suspected of having sabotaged the nation's high-speed rail system over the last several weeks. The arrests aim not only to put an
end to the spate of vandalism that had wreaked havoc and panic among French travelers for the past two weeks; they may also derail any violent plans French anarchists might have been preparing with like-minded extremists with whom authorities say they were in contact in Germany, Belgium, and the U.K. (See Today in Pictures.)

The police raids took place early Tuesday morning in Paris and in four other
sites in France. A total of 20 people were arrested, and by mid-day 10 of
those had been officially placed under investigation for participating in
the spree of potentially deadly sabotage. In most of those incidents, hooked
metal bars had been attached to high-voltage electricity lines that power
high-speed trains; when the bars were snagged by passing locomotives, they
plowed a path of destruction through high-voltage power lines. A
total of six incidents of sabotage were recorded since Oct. 26, including a
coordinated operation Nov. 8 that targeted four different rail lines in
northern France and caused delays of nearly 160 high-speed TGV trains — including Eurostar service to London — leaving thousands of passengers
stranded.

The sudden spate of sabotage capped nearly two years of sporadic
vandalism to French rail lines that successive inquiries attributed to
isolated, disgruntled trouble-makers. But the recent incidents showed
more skill, and their perpetrators seemed able to act at will without
detection. For that reason, French rail users were already rattled even
before the coordinated attacks of Nov. 8. The saboteurs struck in
virtually all corners of the nation without warning, and applied a high
degree of knowledge and technical ability in putting the destructive
metal hooks in place without being killed by the 25,000-volt power
lines.

After a further act of sabotage was reported Monday in southwestern France,
a decision was made to group individual investigations under the direction
of France's centralized counter-terror operation in Paris, which collated
all the information police and intelligence services had related to the
inquiries. Within 24 hours, officials had narrowed their scope down to a
group of "autonomous anarchists" whose radical positions and increasingly
restless activity — including protesting during a G8 summit in Poland
last year — had led French intelligence services to place some of its
members under surveillance.

"They speak a very radical language, and have ties to groups abroad," said
French Interior Minister Michèle Alliot-Marie in announcing the arrests
Tuesday. "Since becoming minister, I've noted the risks of the resurgence of
a violent radical left (given) the radicalization we've observed in it over
the past three or four years."

French terrorism expert Roland Jacquard thinks Alliot-Marie is right to be
concerned — especially given similarities between the accused anarchist
group and Action Directe, which carried out the unit's robberies,
assassinations, and machine gunning attacks. "Like Action Directe, these
anarchists set themselves up in out-of-the-way, rural communities where no
one would suspect them of anything more troubling than perhaps a general
ecologist lifestyle," Jacquard says. "Like Action Directe, these anarchists
used that cover for their plots, and fled back under cover once operations
were over. But like Action Directe, that escalation of activity — and its
success — raised the potential of it sooner or later evolving into more
violent strikes targeting individuals or groups of people." (See pictures of riots in France.)

Guillaume Pepy, chairman of France's state-owned SNCF rail company, didn't
go so far as to speculate about what else the group might have done had it
not been arrested. But he did say the "central role of rail travel as a
collective means of travel that France has made a priority" was also what
made it an inviting target for saboteurs seeking "to strike a blow at a
well-functioning French society."

If so, France's counter-terrorism organizations may not have seen the last
of belligerent behavior by extreme leftist groups that have largely been
dormant since Action Directe was smashed in 1987. "The economic and
financial crisis the world is now experiencing is a dream come true to the
extreme-left, especially with mainstream leftist political parties unable to
mount any real opposition to ruling conservatives," Jacquard notes. "That
brings the possibility of social unrest radical leftists may seek to exploit
— or even provoke through violence of their own."

Tasmanian Forest Protesters Arrested, Logging Industry Violence Continues

Two forest activists were arrested for trespass and obstruction after halting logging operations in the Lower Weld Valley, Southern Tasmania, today. A non violent protest was held in an area of ancient forest in the Weld Valley that is being logged as part of a 118 hectare cable-logging clearfell," Jenny Weber, Spokesperson for Huon Valley Environment Centre said.

"The two protestors who were arrested, Will Mooney and Simon Browning, were part of a larger group who were protesting the on going destruction of Tasmania's high conservation value forests. Will Mooney was subjected to violent and intimidating behaviour by a logging contractor who wielded a large demolition saw near him," Jenny Weber said.

"We call on industry spokespeople to stop their ongoing support for violence. Protestors have always adhered to strict non-violent principles. No one deserves to be treated with violence. Logging contractors have the choice to respond to protestors without violence and in a decent manner,"

"It is time the Premier resolved this ongoing conflict in the forest by protecting high conservation value forest immediately, and offer a compensation package to those who work in the industry," Jenny Weber said.

Dean Cain is alleged to have trespassed at a rabbit farm, and has been charged with:

1. SOCPA 145 (interfering with a contractual relationship so as to harm an animal research organisation).
2. Conspiracy to commit SOCPA 145.
3. Conspiracy to commit criminal damage.

Dean applied for but was refused bail because he was already on bail for taking part in a protest against the Chinese Embassy earlier this year.

French police raided alleged anarchist cells in three cities on Tuesday and arrested at least 10 suspects following a series of sabotage attacks on the country's high-speed rail network.

Interior Minister Michele Alliot-Marie said police intelligence officers had been investigating an "ultra-left anarchist movement" for several months and had acted following the weekend's disruption of train services.

None of those arrested works for the SNCF state rail network, she added.

A source close to the investigation told AFP anti-terrorist officers were examining "possible links between the suspects and the German hard-left, which has claimed responsibility for actions agains trains carrying nuclear waste".

President Nicolas Sarkozy congratulated police on the arrests and welcomed "the rapid and promising progress made in the context of the inquiry".

Thousands of passengers and more than 160 train services were delayed Saturday after a gang jammed steel rods across overhead power cables on three high-speed lines between Paris and London, Brussels and the French regions.

The attack halted trains and damaged several sections of 25,000-volt power lines, but noone was hurt.

In a separate incident on Sunday in the southwest of the country, another high-speed train rammed a pair of concrete blocks placed on a line. There were no injuries and it is not yet clear whether the incident was related.

Alliot-Marie said 10 suspects were being held, but an interior ministry official said more than 20 had initially been detained in raids conducted in Paris, the central town of Tarnac and the northern city of Rouen.

Following Saturday's incident, which followed at least one similar incident involving the use of rods designed to reinforce concrete and a series of other acts of vandalism, officials spoke of a "concerted campaign" of sabotage.

Experts from the SNCF state rail company told reporters that the sophistication of the attacks showed the saboteurs were technically very competent, since neutralising the power lines required expert knowledge.

The TGV high-speed rail network has been the target of several extremist campaigns over recent years by criminals seeking to blackmail SNCF, Basque separatist guerrillas and militant trade unionists.

Saturday's attacks were among the best planned, taking out trains on lines north, east and south of the capital at almost the same moment and plunging the national network into chaos.

In addition to national services, Eurostar trains to Brussels and London and Thalys journeys to the Netherlands and northern Europe were halted.

Despite the most intense protests by anti-nuclear campaigners for several years, a French shipment of radioactive waste arrived in Germany early on Tuesday after a 20-hour delay.

Eleven lorries carrying 123 tonnes of nuclear waste arrived at the Gorleben dump in northern Germany just after midnight (2200 GMT), police said.

For most of the journey from western France the waste travelled by train and was halted for half a day at the German border by three activists who had jammed their arms into a concrete block under the track.

Once in Germany, around 16,000 baton-wielding police were deployed as around 15,000 demonstrators rallied along the route to try to hinder progress using tactics such as setting barricades on fire on the tracks.

The train eventually arrived at its final destination on Monday, more than 14 and a half hours late and the cargo was then transferred to lorries for the final 20 kilometres (12 miles) trip to Gorleben.

Along the final leg some 1,000 activists had to be removed one-by-one by riot police before the lorries could pass. Tractors had been parked across the road and activists chained themselves to tall cement pyramids.

Urge him to sign the amended Executive agreements which will allow NY
inmates Herman Bell (#2318931) and Jalil Muntaqim (s/n Anthony
Bottom/ #2311826) to return to New York State to attend their
rightful parole hearings. We're calling him every Wednesday morning
of '08 until he signs off on the transfer.

On November 4th, people across the US will be in the poll booths
choosing between state leaders. On Wednesday the 5th, take the
opportunity to call on some officials to give a couple of freedom
fighters, men who struggle for visions bigger than Obama's or
McCain's, a chance to attend a parole hearing.

The transfer of SF8 defendants Herman Bell and Jalil Muntaqim from
the San Francisco County Jail back to New York State for their
rightful parole hearings has been blocked by both state governors for
weeks and NYS now wants to deny this right for good. This comes
despite previous agreements in the courtroom between the California
State prosecutors, the presiding judge and, of course, the brothers
and their attorneys.

Judge Philip Moscone signed an order in May allowing Herman Bell and
Jalil Muntaqim to return to New York State for their parole hearings.
All parties agreed at that time that the move would be temporary;
Herman and Jalil waived their rights to fight extradition back to
California. This vindictive and mean-spirited procedural obstacle was
immediately challenged by defense attorneys. Strong arguments were
made to guarantee Herman and Jalil's right to "pursue their liberty
interests" and have parole hearings. Both have served over 35 years
in prison as model prisoners. Both were targeted originally by
COINTELPRO as members of the Black Panther Party.
New York Attorney Bob Boyle argued in a declaration to the San
Francisco Court that if the men remain in California, "they would be
denied their parole hearing for years." In a subsequent interview, he
also said: The state waited 35 years to bring these spurious
criminal charges. Now these charges are being used to deny these men
parole hearings to which they are entitled. Whatever concerns the
government has can be overcome by a simple modification of the
extradition order. All Herman and Jalil are asking for is an
opportunity to attend their hearings.

Eight former Black community activists – Black Panthers and others –
were arrested January 23rd in California, New York and Florida on
charges related to the 1971 killing of a San Francisco police
officer. Similar charges were thrown out after it was revealed that
police used torture to extract confessions when some of these same
men were arrested in New Orleans in 1973.

Richard Brown, Richard O'Neal, Ray Boudreaux, and Hank Jones were
arrested in California. Francisco Torres was arrested in Queens, New
York. Harold Taylor was arrested in Florida. Two men charged – Herman
Bell and Jalil Muntaqim – have been held as political prisoners for
over 30 years in New York State prisons. A ninth man -- Ronald
Stanley Bridgeforth – is still being sought. The men were charged
with the murder of Sgt. John Young and conspiracy that encompasses
numerous acts between 1968 and 1973.

Harold Taylor and John Bowman (recently deceased) as well as Ruben
Scott (thought to be a government witness) were first charged in
1975. But a judge tossed out the charges, finding that Taylor and his
two co-defendants made statements after police in New Orleans
tortured them for several days employing electric shock, cattle
prods, beatings, sensory deprivation, plastic bags and hot, wet
blankets for asphyxiation. Such "evidence" is neither credible nor
legal.

Herman Bell, 59, of Mississippi, a political prisoner since 1973.
Cointelpro's "pattern of manipulation and lies, continuing into the
present, indicates something more than the ordinary corruption and
racism of everyday law enforcement. It can be understood only in
terms of the power of the political movement that [we] were part of,
and the intensity of the government's efforts to destroy that
movement and to disillusion and intimidate future generations of

Jalil Muntaqim (Anthony Bottom), 55, of San Francisco, a political
prisoner in New York since 1978. "The United States does not
recognize the existence of political prisoners. To do so would give
credence to the fact of the level of repression and oppression, and
have to recognize the fact that people resist racist oppression in
the United States, and therefore, legitimize the existence of not
only the individuals who are incarcerated or have been captured, but
also legitimize those movements of which they are a part." Write to

Leonard Peltier: A new spirit of hope

My Relatives and Friends,
Last night a change in this country took place that not too long
ago many people said would never happen. An African-American was
elected to the White House and by a major landslide, which gives
him a mandate by the public to fulfill his promises. This landslide
indicates the people have placed their hope with this man they call
their president for a change in this country.

HOPE. There have been times if I can even recall what it really
means to have hope that justice is right around the corner. I've
been mislead and disappointed so many times that I would soon
see justice and to have it denied upon a technicality in legal
appeals. Or like what happened eight years ago. Everyone placed
their hope and trust with a couple named Bill and Hillary, but we
were betrayed at the last minute. I know that many of my friends,
family and supporters were crushed. I began to feel the weight
and pressure of a lifetime being unjustly imprisoned began to
crowd me into a corner of my cell and then in my mind. But, it
was this thing that has been our battle cry for so many years,
"In the Spirit of Crazy Horse". I remembered what he stood for and
remained a warrior until his last breath. It is a strength that we
stand upon when we are right. We were right to be in Oglala and we
were right to be prepared to defend ourselves. What wasn't right is
that a jury never got to hear any of this testimony, and the rest
of the trial was a product of the fabrication and then manipulation
of the FBI. This spirit of Crazy Horse is a spirit of being in total
resistance to the wrongs perpetuated towards your people, community,
family and yourself. Some of us called it outrage, but that is just
merely an emotion without resolving the issue. It is when we make
a conscious choice to try and balance the wrongs in this society
that we are being compelled by this spirit of resistance to stand
in defense of the wronged.

That spirit cannot be conquered, and I refused to submit and give in
when it appeared there may be no hope. It was because of the letters
of support and encouragement from so many people that I continued
on for another eight years. And now people seem to feel there is
a change blowing in the wind and that the election of Obama is a
manifestation of that change.

I sincerely hope so, because I am now 64 years old and coming up
on my 33 year of being confined and fighting for justice and my
freedom, Obama may be my last chance at securing my freedom. If
there is one thing I learned from earlier campaigns on my clemency is
that he won't just be able to do it by himself. He is going to need
your support in the form of public opinion on the case. That isn't
going to happen until we can create education and awareness on the
circumstances of my case across this country and send letters. Be
a Branch Support Group to help create public opinion. My case
has to be a national issue on justice denied, it may sound easy,
but it isn't. The FBI has been an opposing force in attempting to
discredit my cause and that of Native people since they focused
their attention on the American Indian Movement in the 1970's. When
it appeared that Clinton might actually grant clemency, the agents
went and demonstrated at the White House and utilized their resources
to create doubt in the mind of Clinton.

So in the national awareness goals of the branch support groups it is
going to be your challenge to keep the public interest focused. It
is also another hope that with a whole generation of people who
were born after my wrongful conviction that there will be a renewed
source of energy and actions.

One point that I would like everyone to focus on right now is a
"30 year law" regarding my sentence and parole. At the time I was
convicted, the guidelines said:

"Any prisoner, .shall be released on parole. after serving thirty
years of each consecutive term or terms of more than forty-five years
including any life term, whichever is earlier: Provided, however,
That the Commission shall not release such prisoner if it determines
that he has seriously or frequently violated institution rules and
regulations or that there is a reasonable probability that he will
commit any Federal, State, or local crime." 28 U.S.C. section 28
U.S.C. 4206(d)

I've served more than 30 years of this sentence and have been
considered a model prisoner And the likelihood of committing any
crimes is non-existent due to my age and the humanitarian work I've
pursued to help my people since my incarceration. According to this
law, they have to grant me a parole to my next sentence. But as we've
learned from the past, we cannot take anything for granted so your
letters should be focused on this law to the parole commission and
congressional leaders. If the commission complies with the letter
and spirit of this law, we will have made a significant step towards
my freedom and we will need to maintain and increase this momentum.

The Committee and I have been discussing several ideas and projects
to make this a pro-active campaign. We are currently rebuilding the
former LPSG's into LPBSG's. This is necessary due to a breakdown
with the former Leonard Peltier Defense Committee. I had to turn
to my sister and niece to help me rebuild my defense committee
from scratch. We had no files, records, and merchandise. We have
not been able to make contact with the former coordinator of the
LPDC. We are still hoping to resolve this issue, but until then we
needed to keep moving with the campaign.

We still need all of our former contacts and supporters to reconnect
with us and to update the information so that my Committee can
handle correspondence and contributions. We need everyone who has
supported me to contact the LPDOC and sign onto our listserv so
that you can be updated with information on progress or activities
needed in my campaign.

I will need everyone to work with my Committee and clear any action
with the appropriate people within the Committee. It is important
that we all work together cohesively, instead of scattering our
efforts or resources. We do not intend to discourage ideas or
creativity, but we would like to incorporate such ideas into a
unified larger effort and not act prematurely on some plans we may
have not disclosed due to timing or details being worked out.

Some of the projects we have discussed are conducting rides, walks,
runs and events across the country to create this awareness of my
case. We are initiating efforts to ask bands and artists to host
fundraisers in their area. We've talked about strategies we could
undertake to further my cause, but a lot will depend on how quickly
people come to form my BSG and start organizing in their area.

I also understand that some of us have personality issues with
other people. I hope that many of you can pray or find a way to
rise above this obstacle and work together for one common purpose. I
would like to see so many of my supporters come together in a show
of solidarity. If there really is a change in the air, we will
need each other to bring about change in so many other areas. For
me it has been about our culture and right to be who we are, but
foremost it has been the children and the next generation. WE were
supposed to leave a better world behind for them and how much have we
accomplished? I know that somehow and someway my sacrifice will not
be in vain and that the years I've endured this pain of loneliness
and suffering in confinement will make a better world for those
children and coming generations. That along with my freedom is my
hope, but I will not be able to fulfill it without you. So take a
few minutes and educate yourself on the injustices of my case. It may
shock and outrage you, but you can do something about it, so join us.

US protester in court for contempt

Animal rights activist convicted of contempt of court

Pamelyn Ferdin violated an injunction against demonstrations near the
homes of UCLA researchers. Sentencing is set for Nov. 18.

Pamelyn Ferdin, an activist who has protested the use of animals in
scientific experiments, was convicted of contempt of court Thursday for
violating an injunction against demonstrations near the homes of UCLA
researchers.

Los Angeles County Superior Court Judge John L. Segal, who conducted
Ferdin's hearing in Santa Monica, scheduled sentencing for Nov. 18,
according to a court clerk.

Ferdin was found to have violated an injunction, issued in April at
UCLA's request, when she demonstrated in June near the Westside homes of
UCLA faculty members and distributed fliers that included scientists'
home addresses and phone numbers.

Reached by telephone Thursday, Ferdin said she planned to appeal her
conviction but was proud of her involvement in the protests. She said
the injunction covered other people and did not name her.

"I have every right to hand out the leaflets," said Ferdin, 49, of
Agoura Hills.

In cases that remain under investigation by the FBI, the homes of UCLA
animal researchers have been targeted in recent years with flooding and
attempted firebombing. No arrests have been made in those incidents and
Ferdin said she had nothing to do with them.

UCLA Chancellor Gene Block said he was heartened by Thursday's court
decision.

"It's important to send a message that the tactics used by anti-animal
research extremists are illegal and will not be tolerated," Block said
in a statement.

UCLA has said that all animals used in the university's research are
treated humanely and that their use is important to find cures for disease.

We just wanted to give you a quick update on Eric and then pass along a piece that he recently wrote. After enduring a month and a half with no access to phones or email, Eric finally got his phone access back on October 17 (and email soon after that). He had a hearing about the infraction he was being charged with – unpermitted contact with the media – on October 15, and due to Eric’s determination to fight the charges based on errors made with the filing of the charges, the prison expunged the record and gave him his “privileges” back. This was a huge relief to Eric and his loved ones.

We also just want to remind everyone that Eric’s appeal is still moving forward, and he continues to need your support during this time. Eric has been standing his ground since the day of his arrest, refusing to give in to the ridiculous charges against him – even in the face of a 20 year prison sentence. Please do not forget about him – there are still things you can do.

One of the most helpful things for Eric at this time is donating to his commissary fund. He uses this money to pay for vegan food to supplement what he can get at the chow hall, and to pay for things like stamps, paper, and phone calls to loved ones. These are two of his few remaining connections to the outside world, and as such are extremely important for his sanity and health. The questions brought up here have been with me for some time, & forgive me if they were already explored elsewhere, as i’ve been out of the loop for a minute.

i ran into an exceptional writer’s creation (Baldwin’s No Name on the Street) where i came across a reference to Dante’s “I would not have believed death had undone so many.” i couldn’t help but feel a particular resonance regarding my situation & the larger environment realized by the Green Scare. This Death isn’t in a totally physical sense & whose subtleties may reside at the Heart of what lies before us.

[This may be redundant but i’ve just got to get it out of me or i’m go’n to burst]

To those familiar with debates, it’s known that when one side establishes the terms to be used, it’s only a matter of time before they’ve won the match – the other views have conceded to that particular frame of reference/mind-set which leads to a particular outcome. i found it curious (to say the least) that so many adhered to the given definition of freedom shoved in front of them. What is your definition of freedom at this moment? How are you to share it with others without it being explored by & for yourself? Whose definitions do you with to utilize in perceiving your reality? When that is given up, what occurs? Within this constellation, what are the benefits of exploration? & the repercussion of leaving it obscured?

[Sorry, this following bit of constructive criticism may be hard for some to digest]

Another aspect of this undoing feels like it’s been manifesting itself for some time by the way the (anarchist/radical) community has been/is received by the larger communities with which it comes into contact & interacts (please forgive the generalizations). The folks who have lived within those communities for generations have seen time & again how “energetic youth” (be it from schools, churches, radical groups, etc.) come in to make a change – perhaps gaining some window dressings here & there; but soon most end up leaving & making way for another up & coming generation of exuberance. The majority of those who leave go on to some form of schooling in order to “use the system for good.” So many, falling back on to careers after they’ve earned their credentials as activists.

Here, society at large, smiling a sigh of relief & giving a knowing nod, no longer sees them as lost children; having got it out of their system: they’ve grown up & accepted the responsibility to be truly effective in the world (please re-read that; how many rationalize their choices/actions by adhering to those loaded terms and concepts, consciously or not). ‘Form defines content’ is a hard lesson to learn, and regardless of the intent that initiates a career, a change of priorities is inevitable: concessions are made. Through this a distance is maintained (activist vs. ‘those in need’) – fortified by a colonialist based behavior that has nurtured a divide & conquer loop-hole which only we can close. The safety net which rides along in the back pocket of the privileged becomes a web that bears it’s own poison.

And where do the costs arise?

No matter what choices we make, we’re always allowed back into the fold. The deeper the deviation, the trespass: the higher the toll for return. Actually at that point, the cost is irrelevant (made stark by some of the G.S. cases) because all that matters is the return to comfort: that familiar (given level of) freedom. And who couldn’t relate to the choices made? We’ve been shown repeatedly the outcome: “it’s only natural.”

From my perspective the type of Death we’re Dancing with here is the fear of letting go – letting go of what we’ve been taught (programmed) defines us – that which we are to hold most sacred.

What are the definitions which define your reality?

What choices do they open before you?

And which are closed?

What unfolds because of those choices?

Basically: How do you wish to Live your Life?
Under whose discretion?
What is it you hold Sacred?

go to print news is coming in that the American ELF prisoner, Daniel
McGowan, is being transferred to yet another prison. Constantly moving is
very disruptive for a prisoner. It breaks bonds that you make with other
prisoners. It disrupts your prisoner support network. It delays your
letters of support and above all each move fills you with uncertainty as you
wonder what the next prison will hold.. ELP urges everyone to support
Daniel and to continue to write to him no matter where he may end up. In
the same way we urge everyone to support all of our prisoners. Some are
more famous than others, but all need our support. Since our last
newsletter we've sadly added even more prisoners to our lists including
prisoners from Sweden and Spain. For legal reasons we can not name the
prisoners held in Sweden, but we have still published an e-mail address

meat eater who encourages organic living).

of using explosives against a bank which was linked to funding a eucaliptus
tree planting program (a foreign species of tree which is used in Spain to
make cheep paper, but which is also helping to destroy natural forests).
The bank was also associated with property development along the coast,
construction of the high speed train (AVE) line and construction of
motorways and highways in important ecological areas of Galicia. If found
guilty the prosecution is asking that Giana is jailed for 19 years. (Diet
unknown).

Paola Gori, Via delle Macchie 9, 57124 Livorno, Italy. Il Silvestre
activist awaiting trial accused of allowing her house to be used to plan
illegal activity. (Paola is a vegan).

Bryan Lefey #38664-086, FDC SeaTac, Federal Detention Center, P.O. Box
13900, Seattle, WA 98198, USA. On remand accused of an ELF action that saw
the damaging of GM trees and the damaging of US Forestry Service vehicles.
(Diet unknown).

Jeffrey Luers, # 13797671, CRCI, 9111 NE Sunderland Ave, Portland, OR
97211-1708, USA. Serving 10 years for arson on a SUV dealership & the
attempted arson of an oil truck. The original sentence was 22 years & 8
months, but was reduced on appeal. (Diet unknown).

Marie Jeanette Mason, Clinton County Jail, 1347 E Townsend Rd., Saint Johns,
MI 48879, USA. Awaiting sentencing having pleaded guilty to involvement in
ELF arson against a University building carrying out Genetically Modified
crop tests. Marie also pleaded guilty to conspiring to carry out ELF
actions and also admitted involvement in 12 other ELF actions. Marie is
expected to receive a sentence of between 15-20 years. (Marie is a vegan).

NOVEMBER 7th WEEKEND OF SOLIDARITY FOR OJORE LUTALO!

Long-time New Afrikan Anarchist Prisoner of War, Ojore N. Lutalo is set to max out after 26 years of imprisonment at New Jersey State Prison.
In other words, the department of correctional services is about to reach their deadline for the maximum amount of time they can legally hold Ojore Lutalo under the sentence mandated by the justice system (nevermind the fact that as a Black Liberation Army Prisoner of War he should not have been sentenced under a criminal court at all!).

While his exact release date is still not finalized, it will most likely be late November or early December. The NJ DOC website has his max-out date as December 25th. Ojore, with the help of a lawyer, is in the process of working to get his good time/work credits restored, a result of his victory in the NJ Superior Court in 2007, which overturned a charge the prison convicted him of in 2005. This charge/conviction took away around a year of good time/work credits. This process is still ongoing and we will update people with any changes to his max-out date. In the meantime, the Anarchist Black Cross Federation (ABCF) is initiating a fundraising drive to support Ojore, once he is released, in order for him to transition back to the streets. Money is needed to help Ojore secure housing, food and clothing. This financial assistance will allow Ojore to make the transition more smoothly, knowing that money and housing isn't an immediate pressing matter, giving him the needed time to readjust to the outside world he hasn't seen since 1982.

We are calling for a National Weekend of Fundraising Events for Ojore Lutalo to occur on the weekend of November 7th 2008. Now's a great opportunity to show how our movements support our own! As many former prisoners and their supporters know, coming back home after a doing a long stretch in prison is difficult and without a support base it will be even more difficult. The ABCF, anarchists and many PP/POW activists who have maintained contact and supported Ojore over the years, have benefited immensely from the example that he's set as what it means to be a revolutionary. His untiring advice/criticism to us has helped many of us and our organizations grow politically and deepen, not only our commitment to the struggle to free political prisoners and prisoners of war, but to that of building a revolutionary movement It's our revolutionary duty ensure Ojore has all the support he needs when hits the streets! We encourage all activists to organize fundraisers or donate whatever they can towards Ojore's release fund.

bio of Ojore Lutalo........

Ojore Lutalo is locked down in Trenton, New Jersey, for actions carried out in the fight for Black Liberation. In Ojore's own words, he is "serving a parole violation sentence (we received 14 to 17 years) stemming from a 1977 conviction for expropriating monies from a capitalist state bank (in order to finance our activities) and engaging the political police in a gun battle in December 1975 in order to effect our departure from the bank, and to ensure success of the military operation..."

"After my parole violation term terminated in December 1987, I started serving a forty year sentence with a twenty year parole ineligibility (I was paroled in 1980, and I have been back in captivity since April 20, 1982) that I have received in 1982 for having a gun-fight with a drug dealer. The overall strategy of assaulting a drug dealer is to secure monies to finance one's activities, and to rid the oppressed communities of drug dealers." Ojore was originally arrested with New Afrikan P.O.W. Kojo Bomani Sababu, and was struggling with comrade Andaliwa Clark up until the point that Andaliwa was killed in action within the confines of New Jersey's infamous Trenton State Prison after he shot two prison's security guards in the repressive Management Control Unit (M.C.U.) on January 19th, 1976 when they tried to stop him from escaping from captivity.

Ojore was a comrade of the late Kuwasi Balagoon, a New Afrikan anarchist P.O.W. "I've been involved in the struggle, the war against the fascist state since 1970. I've been an anarchist since 1975 without any regrets. Prior to my involvement in the struggle, I was just another apolitical lumpen (bandit) here in Amerika."
"I was... influenced and highly motivated by the Black Liberation Army (B.L.A.) here in Amerika. These sisters and brothers were New Afrikans just like me from the streets of the ghettos who took the initiative militarily, to start assassinating members of the state's security forces who were murdering black people in our communities. From the inception of all revolutions, I feel that the people need armed combat units to check state sponsored acts of terrorism by the government's security forces. In addition, I feel that these armed combat units are necessary to show the people that fascist acts of state-sponsored terrorism... will be responded to militarily. In 1975 I became disillusioned with Marxism and became an anarchist (thanks to Kuwasi Balagoon) due to the inactiveness and ineffectiveness of Marxism in our communities along with repressive bureaucracy that comes with Marxism. People aren't going to commit themselves to a life and death struggle just because of grand ideas someone might have floating around in their heads. I feel people will commit themselves to a struggle if they can see progress being made similar to the progress of anarchist collectives in Spain during the era of the fascist Bahamonde..."

Ojore is presently locked down in an M.C.U. in Trenton. "I'm encased in a cage of steel and concrete surrounded by by high prison walls topped with gun towers and rows of razor wire while being watched by sadistic fascist pigs. Nevertheless, I'm not complaining because I have accepted revolution, which is an armed struggle for me, and I have come to terms with the prospects of death and captivity... The vast majority of the Prisoners of War and Political Prisoners now being interned here in the concentration camps of North Amerika aren't receiving any assistance (e.g.: being liberated, assistance in liberating ourselves, financial assistance needed to obtain food packages, winter clothing, reading material and postage stamps) from the so-called progressive revolutionary organizations, groups and individuals here in Amerika. With our talents, we have been abandoned here in the state's numerous concentration camps and our M.C.U.¹s by those out there in what we call minimum custody..." We don't need moral support because we have purpose. We don¹t need anyone to tell us to stay strong because we are going to remain stead-fast anyway, because we have come to terms with the prospects of death and captivity."

This is event is brought to you by NYC Anarchist Black Cross and
friends and is part of the fundraising weekend for Ojore Lutalo
called for by the Anarchist Black Cross Federation.

Longtime New Afrikan Anarchist Prisoner of War, Ojore N. Lutalo, is
set to be released after 26 years of confinement in the New Jersey
State Prison, having completed the maximum amount of time the State
of New Jersey could hold him. While his exact release date is not
finalized, it will most likely be late November or December. Money is
needed to help Ojore secure housing, food and clothing. This
financial assistance will allow Ojore to make the transition more
smoothly, knowing that money and housing isn't an immediate pressing
matter and giving him the needed time to adjust to the outside world
he hasn't seen since 1982. The ABCF, anarchists and many PP/POW
activists who have maintained contact and supported Ojore over the
years have benefited immensely from the example that he has set as
what it means to be a revolutionary. His untiring advice and
criticism have helped many of us and our organizations grow
politically and deepen our commitment to the struggle to free
political prisoners and prisoners of war, as well as the broader
struggle of building of a revolutionary movement. It's our
revolutionary duty to ensure Ojore has all the support he needs when
hits the streets!
Frame Up! follows the story of Afro-Puerto Rican political activist
Martin Sostre who served time in Attica prison during the early
1960s. There, Sostre embraced doctrines as diverse as Black Islam,
Black Nationalism, Internationalism, and finally anarchism. Arrested
on July 14, 1967, at his Afro-Asian bookstore in Buffalo for sale and
possession of narcotics, riot, arson, and assault--charges later
proven to be fabricated and part and parcel of a COINTELPRO program
in full swing--he was convicted and sentenced to serve forty-one
years and thirty days. Sostre became a jailhouse lawyer and
regularly acted as legal counsel to other inmates, including winning
two landmark legal cases involving prisoner rights: Sostre v.
Rockefeller and Sostre v. Otis. According to Sostre, these decisions
constituted "a resounding defeat for the establishment which will now
find it exceedingly difficult to torture with impunity the
thousands of captive black (and white) political prisoners illegally
held in their concentration camps."

Ojore Lutalo is locked down in Trenton, New Jersey, for actions
carried out in the fight for Black Liberation. In Ojore's own words,
he is "serving a parole violation sentence (we received 14 to 17
years) stemming from a 1977 conviction for expropriating monies from
a capitalist state bank (in order to finance our activities) and
engaging the political police in a gun battle in December 1975 in
order to effect our departure from the bank, and to ensure success of
the military operation..."

Ojore was a comrade of the late Kuwasi Balagoon, a New Afrikan
anarchist P.O.W. "I've been involved in the struggle, the war against
the fascist state since 1970. I've been an anarchist since 1975
without any regrets. Prior to my involvement in the struggle, I was
just another apolitical lumpen (bandit) here in Amerika."

NOTICE: This notice informs you of your transfer to a Federal Bureau of Prisons (Bureau) facility that allows greater management of your communication with persons in the community through more effective monitoring of your telephone use, written correspondence, and visiting. Your communication by these methods may be limited as necessary to allow effective monitoring. Your general conditions of confinement in this unit may also be restricted as necessary to provide greater management of your communications. Your transfer to this unit, by itself, will have no effect on the length of your incarceration. You will continue to earn good-conduct sentence credit in accordance with Bureau policy.

Your offense conduct included acts of arson, destruction of an energy facility, attempted arson, and conspiracy to commit arson. You have been identified as a member and leader in the Earth Liberation Front (ELF) and Animal Liberation Front (ALF), groups considered domestic terrorist organizations. Your offense conduct included communicating in code and teaching others how to commit crimes of arson. Your actions had the primary purpose to influence and affect the conduct of government, commerce, private business and others in the civilian population by means of force, violence, sabotage, destruction of property, intimidation and coercion. Your contact with persons in the community requires heightened controls and review.

Based on this information, your transfer to this facility for greater communication management is necessary to the safe, secure, and orderly operation of Bureau institutions, or protection of the public. Your continued designation to this facility will be reviewed regularly by your Unit Team under circumstances providing you notice and an opportunity to be heard, in accordance with the Bureau's policy on Classification and Program Review of Inmates.

OPPORTUNITY TO APPEAL TRANSFER DECISION - You may appeal this transfer decision, or any conditions of your confinement, through the Bureau's Administrative Program, 28 C.F.R. ON 3 NOVEMBER 2008 NEW WAVE OF PRISONERS MOBILIZATIONS STARTS WITH A COLLECTIVE HUNGER STRIKE AROUND THE WHOLE COUNTRY

PRISONERS DEMANDS

We the prisoners of the hell called with an euphemism: prisons of the greek state, tired with the fake promisses of all justice ministers in the last 10 years, to ameliorate prison conditions and the penal code and the penal justice code, decided to move forcefully, in order to claim our rightful demands.

WE DEMAND:

1. Abolish disciplinary charges. Modify the Penitentiary Code's articles 68, 69, 70, 71. In any case, the disciplinary charges must be removed after the are served, and not accumulated nor taken into consideration when it comes to days off, work, education and discharge under conditions after they are served.
2. Reduction of the sentence limit for discharge under conditions, from 3/5 to the 3/7 of the sentence time. Immediate abolishment of the anti-constitutonal treaty that increased up to the 4/5 of crimes related to drugs.
3. Once and for all 3 year reduction of all prices, to make easier the relieve of over-crowding of prisons. NO to the new panoptic prisons, built isolated away from the cities social tissue.
4. Abolish the juuvenile prisons. Adopt open structure to take care of and protect the teenagers and youth.
5. Reduction of sentence limit of 25 years of continuous detention. Reduction of the minimum detention time to be discharged under conditions to 12 years from 16 that it is today, according to european legislature.
6. Immediate and without exceptions application of days-off, suspensions, and other benefits of the law, reduction of the minimal sentence time limits. Increase the number of days-off to 60 for those that have a right to 5 days and to 96 for those with a right to 8.
7. To end the over-use of pre-trial detentions and reduce the time limit to 12 months.
8. The para-justice racket is known for its hysteria of the last 8 years, leading to revengeful killing sentences. We as for proportionate sentences and wide application of the measure of suspension and discharge under conditions.
9. Full, permanent and 24 hour medical treatment and respect to the patients. Creation and improvement of adequate hygiene spaces (baths and toilets). Immediate integration of the Korydallos prison psychiatric and medical clinic to the National Health System, with new aisles for women and juveniles, that lack now. Immediate transportation of patients to public hospitals with ambulances and not in police vehicles, tied up with their hands behind their back.
10. To be provided the right in beneficial work payment, education, second chance schools, technical workshops and participation in diverse similar programms, to all prisoners proportionate and without any discrimination. To be given educational days-off, for all prisoners, that meet with the criteria and terms to study outside prison and for all levels of education and technical skills learning. Substancial amplification of withdrawal projects to all prisons.
11. Abolishion of the prison no-go zone. Free access for social and political institutions, Lawers Associations, Hellenic Medical Association and EINAP, organizations for human rights, NGOs and international organizations. Free circulation of political and educative press, with no exceptions.
12. Alternative forms of detention, amplification of agricultural prisons and of the institution of semi-free sentence as well as community service.
13. Amplification of the institution of free visits in humain conditions with respect to the personality and dignity of the prisoners and the visitors. Private place to meet with our companion.
14. Work and access to creative activities for all of us. Beneficial account of days of work in the sentence.
15. Right to selection of serving the sentence in their country of origin, for the prisoners from other countries, once and if they wish.
16. Humain transport conditions with improvement of the room in the preposterous transportation means of the greek police. More stops, improvement of the detention room in the miserable "Metagogon" transfer prison and faster transfer to the destination prisons.

DEMANDS OF THE WOMEN PRISONERS AT ELEONAS, THIVA PRISON:

On the occasion of the third-world life conditions inside this establishment but also our treatment by the totality of the ministry of justice services, and more precisely: Inexistant medical-pharmaceutical supply. Few, to even inexistant hygiene supply (without any right to a private purchase). Inexistant basic hygiene (no warm water). Inexistant social services and care. Preposterous food, because of luck of supplies. Even first need stuff is an unknown word here. Racist treatment of the prisoners when it comes to days-off and suspensions. Injust treatment of sentence accounts for suspension proportionate to the offence (2/5, 3/5 etc). Vast delays when it comes to bringing the case to the courthouse and especially the court of appeals. The peculiar stiffness of the persons judging us, despite the recommendations they have received. The inexistant second chance we are all waiting for and most of us have a right on it, but are never given. We decided to abstain from prison food commons from 03/11/2008 until proportionate measures are taken in regards to all the above. We expect your understanding.

Urge him to sign the amended Executive agreements which will allow NY
inmates Herman Bell (#2318931) and Jalil Muntaqim (s/n Anthony
Bottom/ #2311826) to return to New York State to attend their
rightful parole hearings. We're calling him every Wednesday morning
of '08 until he signs off on the transfer.

On November 4th, people across the US will be in the poll booths
choosing between state leaders. On Wednesday the 5th, take the
opportunity to call on some officials to give a couple of freedom
fighters, men who struggle for visions bigger than Obama's or
McCain's, a chance to attend a parole hearing.

The transfer of SF8 defendants Herman Bell and Jalil Muntaqim from
the San Francisco County Jail back to New York State for their
rightful parole hearings has been blocked by both state governors for
weeks and NYS now wants to deny this right for good. This comes
despite previous agreements in the courtroom between the California
State prosecutors, the presiding judge and, of course, the brothers
and their attorneys.

Judge Philip Moscone signed an order in May allowing Herman Bell and
Jalil Muntaqim to return to New York State for their parole hearings.
All parties agreed at that time that the move would be temporary;
Herman and Jalil waived their rights to fight extradition back to
California. This vindictive and mean-spirited procedural obstacle was
immediately challenged by defense attorneys. Strong arguments were
made to guarantee Herman and Jalil's right to "pursue their liberty
interests" and have parole hearings. Both have served over 35 years
in prison as model prisoners. Both were targeted originally by
COINTELPRO as members of the Black Panther Party.
New York Attorney Bob Boyle argued in a declaration to the San
Francisco Court that if the men remain in California, "they would be
denied their parole hearing for years." In a subsequent interview, he
also said: The state waited 35 years to bring these spurious
criminal charges. Now these charges are being used to deny these men
parole hearings to which they are entitled. Whatever concerns the
government has can be overcome by a simple modification of the
extradition order. All Herman and Jalil are asking for is an
opportunity to attend their hearings.

Eight former Black community activists – Black Panthers and others –
were arrested January 23rd in California, New York and Florida on
charges related to the 1971 killing of a San Francisco police
officer. Similar charges were thrown out after it was revealed that
police used torture to extract confessions when some of these same
men were arrested in New Orleans in 1973.

Richard Brown, Richard O'Neal, Ray Boudreaux, and Hank Jones were
arrested in California. Francisco Torres was arrested in Queens, New
York. Harold Taylor was arrested in Florida. Two men charged – Herman
Bell and Jalil Muntaqim – have been held as political prisoners for
over 30 years in New York State prisons. A ninth man -- Ronald
Stanley Bridgeforth – is still being sought. The men were charged
with the murder of Sgt. John Young and conspiracy that encompasses
numerous acts between 1968 and 1973.

Harold Taylor and John Bowman (recently deceased) as well as Ruben
Scott (thought to be a government witness) were first charged in
1975. But a judge tossed out the charges, finding that Taylor and his
two co-defendants made statements after police in New Orleans
tortured them for several days employing electric shock, cattle
prods, beatings, sensory deprivation, plastic bags and hot, wet
blankets for asphyxiation. Such "evidence" is neither credible nor
legal.

Herman Bell, 59, of Mississippi, a political prisoner since 1973.
Cointelpro's "pattern of manipulation and lies, continuing into the
present, indicates something more than the ordinary corruption and
racism of everyday law enforcement. It can be understood only in
terms of the power of the political movement that [we] were part of,
and the intensity of the government's efforts to destroy that
movement and to disillusion and intimidate future generations of

Jalil Muntaqim (Anthony Bottom), 55, of San Francisco, a political
prisoner in New York since 1978. "The United States does not
recognize the existence of political prisoners. To do so would give
credence to the fact of the level of repression and oppression, and
have to recognize the fact that people resist racist oppression in
the United States, and therefore, legitimize the existence of not
only the individuals who are incarcerated or have been captured, but
also legitimize those movements of which they are a part." Write to

Urgent Call for Help for the ♀ly-26

Women Targeted for Prosecution in Non-Violent Port Protests

Prosecutors have brought charges against twenty-six people arrested
during a non-violent women's protest in November, 2007.

Thoughtful, Moral Demonstrations

For two weeks in November, hundreds of demonstrators blocked military
equipment from moving through their publicly owned port. On November
13th, 39 women were arrested during a non-violent demonstration in
solidarity with each other, women nationally, and the women in Iraq.

Patty Imani, one of those charged, said Friday: "Thousands of women
have been killed in Iraq. It's obscene that the city's response is to
jail those of us who were only trying to stop more from dying."

The women in Olympia saw the suffering that the United States'
occupation of Iraq was causing, to the Iraqi people and particularly
to the women of Iraq. The protest was carefully planned to bring
attention to how the war has effected the lives of women in Iraq and
the United States.

Inappropriate Prosecution

The City has waited nearly a year to bring these charges, and has
suspiciously brought these new charges less than a week after their
other cases against port protesters were dismissed. Also, prosecutors
have a history of targeting women and people of color in protest
cases. Twenty-six demonstrators have been singled out for
prosecution, 25 of whom are women.

A Call for Solidarity

Those being prosecuted are calling for solidarity and support from
all those who are concerned that women and people of color are being
targeted for carrying out their constitutionally protected right to
non-violently dissent.

Defendants are available to speak to the press.
