Animal activists picket U researchers, go to jail

Police in Salt Lake City arrested four people and
cited 12 others who were protesting animal research.

The protest and the arrests occurred in the 2700 East block of Eagle
Way Sunday at an address published by animal rights activists as the
home of two University of Utah brain researchers.

Police were called to the address about 1 a.m. Sunday and said they
found 10 people, most of whom were wearing bandanas on their face. The
group said they were holding a silent candlelight vigil and the bandanas
were for the "faceless victims" of animal research, according to a
police log.

No arrests or citations were made at the time, but police returned
about 8 p.m. and found 16 protesters. This time, police cited 12 people
for picketing in a residential area. The other four were arrested and
taken to jail on suspicion of the picketing, providing false information
to police and outstanding warrants.

No injuries or damage was reported.

Last Friday I was officially transported back to prison. So, I guess this is the beginning of the end. And what a beginning it has been.


This is how it started….


I meet with my intake counselor last Monday. This is the person who decides what my custody level is, and what types of programs (i.e. anger management) if any I need to take. In short, the counselor sets the stage.


This meeting was unique in that for the first time I got to see my file—the one that has always caused me so much trouble. The one that got me pulled off the bus by a captain when I arrived at intake. It is a thick file with a bright red sticker on it that says “Danger Escape Risk.


That’s how it started. My counselor asked why that sticker was there. I figured it was a rhetorical question. I mean, he had the file and I surely didn’t know. But that was just it. He didn’t know either. He couldn’t find anything.


Then he asked about my sensitive inmate listing, which is a label for inmates who are believed to be dangerous. I replied that maybe it had something to do with my support. I received a quizzical stare. I didn’t elaborate.
What’s the point?

Much to my surprise, my counselor said, “Well, I can’t see why they have all of these restrictions on you. There’s nothing to support it.” So he removed all of them, listed me as minimum one—the lowest custody level possible, and that was that.


Of course, the next day he came back. The conversation started like this, “Mr. Luers, I didn’t know who you were yesterday. But I’ve Googled you. Do you know how many people you have out there?” And so began more meetings with security lieutenants and captains. I was told I would stay minimum but would be going back to Oregon State Prison, Oregon’s only maximum-security prison.


So, it took me by surprise when they brought me to a minimum-security prison in Portland. It’s the same kind of shock I experienced when I was arrested. I’ve just been taken from my family again.


That may sound strange. But I’ve spent the last 7 years at OSP. The friends and brothers I’ve left behind were family to me. In fact, I’ve spent more time with them than most other people in my life. Many of them are doing life, most I’ll never see again.


I’m dealing with the separation from my friends while trying to adjust to a place where people aren’t carrying shanks and people don’t get killed. Things that are definite improvements from OSP, yet also make for a more disrespectful attitude among inmates. The fear of crossing the wrong line at OSP makes everyone very cautious and respectful. Lots of please, thank you, and excuse me. Here there’s not the same level of politeness. I’m having trouble adjusting. In a way I miss OSP.


One can also possess less property here. Something that means getting rid of lots of stuff once my property finally arrives from OSP.


There are dorms here and not cells. The yard is very small, though I can get out more. One thing surprising or at least new is the trees around the yard. Cedars and pines, fragrances I haven’t smelled in years. And frogs. I heard frogs the other night. I even did my own laundry, a first in 8 years. It took me a while to remember how ironing is my next task. Though I’m gonna put it off as long as possible—it’s something I’ve never done and I’ve seen all the comedies with the iron burnt shirt.


Still, I’m not happy or content here. I don’t think I will be. I accepted OSP as home. This place is not home. I feel in transition, but a transition I do not control. Right now I’ve got around 20 months left if things hold. But maybe I’ll go to camp—maybe not. They don’t tell you and there are 7000 people eligible. So who knows? I really want to take some college correspondence courses. But I’m worried I’ll sign up and spend lots of money only to end up in boot camp where I can’t do them. Or I’ll not sign up and wait on boot camp only to not get in.


I’m left not knowing what to do. It’s not a position I like. My future is up in the air and I don’t feel in control of it yet. But, one thing is certain: I have a future I can look forward to that is only 20 months away, or sooner if I get into boot camp.


So like everyone else I guess I’ll watch and wait and see what happens. I should be used to that by now, but naturally I am not.

Witch-Hunting the Environmental Movement

The Politics of Green Scare

In May 2005, FBI Deputy Assistant Director for Counterterrorism John Lewis told a Senate panel that ecoterrorism is "one of today's most serious domestic terrorism threats." Then the FBI's James Jarboe estimated that two organizations (the Earth Liberation Front - ELF and Animal Liberation Front - ALF) committed over 600 criminal acts since 1996, causing over $43 million in damage. For his part, Lewis said both groups committed more than 1100 such acts since 1976, "conservatively" resulting in around $110 million in damages.


What's going on, and is there anything to these charges? Coming from FBI sources makes them highly suspect, especially when there are two types of documented cases:

-- people guilty of non-violent offenses called "terrorism" and given excessively harsh sentences; and most disturbing

-- innocent people targeted, accused, convicted and sentenced to hard time for environmental activism or supporting animal rights; and that's on top of hundreds of other political persecutions and many thousands of innocent people (or petty criminals) in US prisons.


This behavior isn't new in America, but things heated up after 9/11 with the administration wasting no time getting going. That evening, George Bush addressed the nation and declared a "war against terrorism," asked for world support, and began the government's "emergency (preventive war strategy) response plans." It was planned and ready before 9/11 as a "war of terrorism" to defile the law, wage aggressive wars, usurp unprecedented powers, destroy our civil liberties, and convince the public to sacrifice freedom for the security they never got. In addition, the October 2001 USA Patriot Act (written well before 9/11) created the federal crime of "domestic terrorism" that broadened the definition and applied it to US citizens as well as aliens.


When John Lewis addressed another Senate panel in May 2004, he stated that "the FBI divides the terrorist threat facing (the country) into two broad categories, international and domestic....and during the past decade we have witnessed dramatic changes in the nature of the domestic terrorist threat." For a while "right-wing extremism" (loosely defined as the militia movement) overtook left-wing terrorism (but in) the past several years....special interest extremism (from groups like) the Animal Liberation Front (ALF), the Earth Liberation Front (ELF), and related extremists, has emerged as a serious domestic terrorist threat." That view is amplified on the FBI's web site that states the Bureau "is part of a vast national and international campaign dedicated to defeating terrorism" with ecoterrorism a key part of it.


The FBI defined it in 2002 to mean: "the use or threatened use of violence of a criminal nature against innocent victims or property by an environmentally-oriented, subnational group for environmental-political reasons, or aimed at an audience beyond the target, often of a symbolic nature.
"

Activists refer to a tactic called "monkeywrenching" from the 1985 Dave Foreman/Bill Haywood-edited book "Ecodefense: A Field Guide to Monkeywrenching.
" It describes it as:

-- "nonviolent resistance to the destruction of natural diversity and wilderness (and) never directed against human beings or other forms of life;

-- strategic....thoughtful (and) deliberate in order to succeed;

-- individual or very small (group actions) of people who have known each other for years (and have) trust and a good working relationship;

-- targeted (because) mindless, erratic vandalism is counterproductive as well as unethical;

-- timely (and) not....when there is a nonviolent civil disobedience action;

-- dispersed (to) hasten overall industrial retreat from wild areas;

-- fun (even though it's) serious and potentially dangerous;

-- not revolutionary....to overthrow any social, political, or economic system;

-- simple (with) elaborate commando operations generally avoided; and

-- deliberate and ethical (by being) the most moral of all actions: protecting life, defending Earth.
"

The Earth First Journal defines the practice as: "Ecotage (environmentally-motivated sabotage), ecodefense, billboard bandit(ry by sawing offensive ones down), road reclamation (to remediate environmental damage), tree spiking (with nails to discourage destructive logging), even fire." These are unlawful sabotage acts "of industrial extraction and development equipment, as a means of striking at the Earth's destroyers where they commit their crimes and hitting them where they feel it most - in their profit margins." It goes "beyond civil disobedience. It is nonviolent, aimed only at inanimate objects. It is one of the last steps in defense of the wild....by an Earth defender when almost all other measures have failed.
"

In May 2004, Republican George Nethercutt targeted them by introducing the Ecoterrorism Prevention Act of 2004, but it didn't pass. If it had, it would have made a federal crime: "certain violent, threatening, obstructive, and destructive conduct that is intended to injure, intimidate, or interfere with plant and animal enterprises, and for other purposes.
"

Republicans tried again in July with the Terrorism Against Animal-Use Entities Prohibition Improvement Act that would have amended the 1992 Animal Enterprise Protection Act and made it harsher. It also failed to pass, but defeat was only temporary.


On November 27, 2006, the Animal Enterprise Terrorism Act (AETA) amended the 1992 act and became law with very harsh provisions. It's language is broad and vague, but it criminalizes First Amendment activities that advocate for animal rights like peaceful protests, leafleting, undercover investigations, whistleblowing and boycotts.


The new law updates the earlier act with penalties far exceeding comparable offenses under other laws. It also goes much further. It allows expanded surveillance of animal rights organizations, including criminal wiretapping, and makes it easier for a court to find probable cause for the vague crime of economic damage or disruption than for one requiring hard evidence a person or group plans to commit these acts.


The bill exempts "lawful public, governmental or business reaction to the disclosure of information about an animal enterprise," but that only applies to economic disruption claims, not damage, and makes it hard to distinguish between the two.
It also:

-- expands the kinds of facilities covered by adding ones that use or sell animals and animal products;

-- covers any person, entity or organization connected to an animal enterprise;

-- applies to any form of advocacy;

-- criminalizes threatening conduct and protected speech as well as communication with anyone engaging in these practices;

-- protects corporate animal abusers with a vested interest in silencing dissent; and

-- targets any form of civil disobedience or protest activity and designates animal advocates as terrorists even when they cause no physical harm; in addition, the bill's language is so broad and vague (by design), it's hard to know the difference between legal and illegal behavior; it's an act of green scare state terrorism that, in fact, can be used against anyone.


Green Scare - A Definition

Activists equate it to earlier Red Scare periods after WW I and II when the government used various schemes to incite fear, sanction witch hunt prosecutions, and win widespread public approval for them. The term may first have been used in 2002 and refers to legal and extralegal government actions against animal liberation and environmental activists. The Spirit of Freedom prisoner support network defines it as "tactics the government and (their enforcement agencies use) to attack the ELF/ALF (Earth Liberation Front and Animal Liberation Front) and specifically those who publicly support them.
"

The term also refers to the 2005 arrests, indictments and convictions from the FBI's Operation Backfire against alleged ELF/ALF activists. It charged them with damaging property, conspiracy, arson and using destructive devices.


The Operation was the FBI's code name for its ten year domestic "war on terrorism" that's, in fact, a war on dissent. It resulted in 17 Pacific Northwest arson indictments with evidence that was very suspect. It came from a heroin-addicted self-professed serial arsonist whose former girl friend mentioned him in a grand jury proceeding. On December 7, 2005, it culminated when federal and local law enforcement agents began the largest ever roundup of alleged environmental and animal liberation activists. Seven arrests were made in four states, others got grand jury subpoenas, and people seized were charged with various acts of destroying property as part of ELF and ALF efforts.


Those arrested faced potential unprecendented sentences for non-violent acts from which no one was harmed. In some cases, they could be mandatory 30 year periods and in others life if found guilty on all counts. That compares to a median sentence of five years for arson.


With that as a threat, all but four defendants testified against the others in return for leniency. The remaining four struck plea bargains to admit responsibility but incriminate no one else. At sentencing in June 2007, the presiding judge was harsh. He included Terrorism Enhancements (TE) that are used when the justice department decides a crime aimed to influence or coerce government policy. It means sentences may be longer, and the Bureau of Prisons gets greater latitude in assigning prisoners that may be to "supermax" facilities for the most violent offenders.


In this case, sentences ranged from three years, one month to 13 years with most defendants getting added TEs. In addition, on October 26, 2007, FBI informant and serial arsonist Jacob Ferguson pleaded guilty to one count of arson and an additional count of attempted arson. According to his plea bargain, he won't be charged for his other offenses. Further, he's required to make no restitution, his formal sentencing keeps being postponed, it may come up ahead, but prosecutors recommend he spend no time in prison, receive no fines, and be able to keep the $50,000 or more he was paid for cooperating.


That's the state of things today where anything goes in the "war on terrorism" and publicizing arrests and convictions takes precedence over justice. Unless stopped, things will only get worse.


ELF and ALF - A Brief Description

On its web site, ELF describes itself as "an underground movement with no leadership, membership or official spokesperson" and uses its site "to inform and chronicle issues related to ELF.
" It further states:

-- "Any individuals who committed arson or any other illegal acts under the ELF name....choose to do so....and do so only driven by their personal conscience;

-- These choices are not endorsed, encouraged, or approved of by this web site's management, webmasters, affiliates, or other participants;

-- The intention of this web site is journalistic in intent only to inform and chronicle issues related to ELF;

-- The owners, management, webmasters, affiliates, or other participants of this website are not spokespersons, members, or affiliates of The Earth Liberation Front in any way; nor do the opinions of anyone acting in the name of The Earth Liberation Front or ELF, represent the opinions of" those affiliated with this site.


Others refer to the ELF as a collective of autonomous individuals or cells that use "economic sabotage and guerrilla war to stop the exploitation and destruction of the natural environment." The organization was founded in Brighton, England in 1992, spread across Europe by 1994, and is now an international movement in over a dozen countries. The FBI designated ELF its top domestic terror threat in March 2001 and called the group "ecoterrorists.
"

The ALF is an international animal liberation organization with roots in the 19th century and with no formal membership or leadership. Its web site defines "animal rights" as "the philosophy of allowing nonhuman animals to have the basic rights that all sentient beings desire; freedom to live a natural life, free from human exploitation, unnecessary pain and suffering, and premature death." It believes animals aren't property any more than humans are and asks if animal rights will become the "next great social justice movement." It cites President of the Australian Law Reform Commission (ALRC) David Weisbrot saying treating animals is increasingly becoming a social and legal issue as well as an important economic one.


Its members engage in direct action on behalf of animals, including removing them from laboratories and fur farms (they call liberation, not theft) and sabotaging animal testing and industry animal-based facilities. Its statements affirm it supports any acts that further animal liberation where reasonable precautions are taken not to endanger life. Its covert cells operate in dozens of countries clandestinely and independently of each other. In January 2005, the Department of Homeland Security (DHS) designated ALF a domestic terrorist threat.


Examples of Witch Hunt Convictions

Many can be cited, but Jeff Luers' case is typical. In June 2001, he was sentenced to 22 years, eight months for burning three SUVs to raise awareness of global warming and how these gas-guzzlers contribute to it. No one was hurt, $40,000 in damages resulted, and the vehicles were refurbished and subsequently sold. Jeff is a political prisoner, and his sentence exceeds that for murder, kidnapping and rape under Oregon law where he resides. He appealed in January 2002, the hearing was held in November 2005, and on February 14, 2007 the Appeals Court remanded his case to the Circuit Court for resentencing. The case was heard on February 28, 2008 after which his sentence was reduced to 10 years.


Josh Harper is another political prisoner who committed no crime. He's an activist believer in animal liberation, preserving the wilderness, and participated in human freedom projects for over 10 years. In 1997, he co-created Breaking Free Video magazine and went on speaking tours in 1999. He also sabotaged a whale hunt, defied grand juries, and contributed to confrontational protest campaigns. It made him a target and got him indicted for violating the Animal Enterprise Terrorism Act (AETA).


Evidence at his trial was mostly from two of his speeches in 2001 and 2002. He spoke about already committed political sabotage acts as well as European anti-vivisection campaigns he supported. He also ended one speech by demonstrating how to participate in a form of electronic civil disobedience called "black faxing" that involves sending multiple black paper sheets through an opponent's fax machine. It got him arrested, charged and convicted.


He was one of six animal rights activists in the so-called SHAC 7 (Stop Huntingdon Animal Cruelty) case. Charges against one of the original 7 were dropped. SHAC is an international animal rights campaign against Huntingdon Life Sciences (HLS) - one of the world's largest contract research organizations, UK based, and operating on three continents. It's also Europe's largest contract animal-testing laboratory and uses around 75,000 animals each year in its operations.


UK-based activists established SHAC in 1999 and successfully closed down two animal-testing operations in their country. It's now a worldwide campaign, the first of its kind, and it operates in the UK, US, the Netherlands, Germany, Italy as well as many other countries. It calls its campaign "innovative" and states it doesn't "encourage or incite illegal activity.
"

On March 2, 2006, Harper and his co-defendants were charged and convicted of conspiracy to violate AETA (and several other charges) and got sentences of from four to six years. The case was an appalling miscarriage of justice for violating the defendants' First Amendment rights that AETA repealed for these activists. The defendants weren't charged with violent or threatening acts. Instead, the case was based on the notion that animal rights organizers are responsible for actions others take that the prosecution equated to a global conspiracy.


Briana Waters is another example of gross injustice. She's an innocent woman charged and convicted. On March 30, 2006, she was arrested and accused of being a lookout in connection with an alleged 2001 arson at the University of Washington Center for Urban Horticulture. Waters is a California resident, violin teacher and mother of a young child. She was indicted, then reindicted with other defendants on May 10 on charges that included using a destructive device that carries a mandatory 30 year sentence.


On December 26, 2007, her lawyers filed a motion accusing the Justice Department of concealing vital exculpatory information as well as producing a fraudulent FBI report. The agency is infamous for creating "evidence" out of whole cloth and getting manipulated informants to state it. Nonetheless, a hostile federal judge denied defense's motion and went further as well. He ruled against allowing a defense expert to rebut government "evidence" that a delayed incendiary device was a bomb.


One of Waters' attorneys expressed outrage over a common federal practice of "The government hand-picking (the) judge (and) manipulating court procedures. This is a classic case of a corrupt prosecution, and a judge who apparently chooses to look the other way." It's no surprise at a time two-thirds of all federal judges are from or affiliated with the extremist Federalist Society. It advocates rolling back civil liberties; ending New Deal social policies; opposing reproductive choice, government regulations, labor rights and environmental protections; and subverting justice in defense of privilege.


Waters was up against this when her trial began on February 11, 2008. She was further disadvantaged by the government's case being based on two informants who struck a plea bargain by pleading guilty to conspiracy, arson and destructive devices in return for leniency. On March 6, Waters was convicted on two arson counts, but the jury deadlocked on the more serious charges of a destructive device and conspiracy. Despite prosecution claims, no devices were found nor was there evidence of conspiracy. That raises serious questions of the government's falsifying evidence and lying to the jury about it. Again, no surprise under witch hunt justice with innocent people like Briana being harmed.


Her case also featured circumstantial evidence, including a folder containing radical pamphlets with a note on the cover from Waters to one of the informants. She testified that she didn't write them or subscribe to their views. The prosecution claimed otherwise. Her defense also argued that Waters knew nothing about the materials, they were substituted for ones she put in the folder, and her fingerprints weren't on the ones in it for proof.


Civil rights attorney Ben Rosenfeld said the "government's case was primarily based on character assassination and guilt by association (and that) evidence of other people's writings should never have been allowed to be used against her." He also denounced former Attorney General Gonzales for proclaiming Waters guilty in the media after she was indicted. He harmed her chances at the outset and showed convictions count more than justice, especially when charges of terrorism are raised. Waters strongly defends her innocence and will likely appeal the verdict. Sentencing is on May 30.


A Look Ahead

Post-9/11, future prospects look grim with fear prevailing over reason, a bipartisan effort exploiting it, and convictions more important than justice. If friends of the earth and animal rights champions are targeted, so can anyone. Governments today won't protect us and neither do courts that defer to their lawlessness. As a result, expect lots more innocent people hurt because those in power want unlimited amounts of it and won't let anyone stop them from getting it. It means hard times ahead when the law won't protect us, dissent is a crime, and the greater good is sacrificed to benefit the privileged.


What to do? Get active, organize, speak out, resist, and use the law for whatever justice is still under it. Things are very dire, change isn't coming next year, and, more than ever, apathy isn't an option. In America's "war on terrorism," we're all potential targets.

Shawn Brant Arrested on Trumped-Up Charges Once Again

After a tense exchange this morning, in which the OPP informed Mohawk
spokesperson Jason Maracle to get people out of the area or they would
come in, the OPP instead disbanded a Mohawk roadblock erected on the
perimetre of the reclaimed quarry site. This psychological warfare on
the part of the police resulted in a tense face-off between the OPP
and community members. At present, the OPP has removed one of the
roadblocks on the Slash Road and pulled back, but remains present in
the direct vicinity of the quarry in great numbers. At the centre of
the dispute is the Culbertson Tract, land which rightfully belongs to
the Mohawks of Tyendinaga. Community members have been occupying a
gravel quarry site for over a year.

In addition, a blockade of Highway 6, taken in support of the
Tyendinaga Mohawks, continues by people of the Six Nations of the
Grand River Territory. Six Nations community members have said they
will remove the Highway 6 bypass blockade once they receive
confirmation the OPP have withdrawn from the Mohawks of Tyendinaga.
The road is now barricaded with a downed hydro tower, wires and a
telephone pole.

Important to note is that, despite the reporting in mainstream press,
Mohawk spokesperson Shawn Brant's arrest on Friday, April 25th stems
from an incident which took place on Monday April 21st. Specifically,
Shawn Brant has been charged for his role in allegedly preventing
further attacks on a woman from Tyendinaga and a young child by racist
rednecks from the town of Deseronto.

These new charges were laid less than two weeks after Shawn Brant was
acquitted of charges alleging that he threated Canadian Forces
soldiers during a demonstration to prevent development of the
Culberston Tract in 2006.

Once again, for his role as a spokesperson in the community, Shawn
Brant is facing trumped-up charges. Arrested during an interview he
was conducting with APTN, Shawn's final words during his arrest on
Friday were "This is it, justice for first nations communities: lock
us up. Anybody who speaks out, lock-em up. KI6, Bob Lovelace: lock-em
up...Don't fix the problems, lock-em up." (to watch, click on

Supporters rushed to the quarry after watching or hearing of Shawn's
arrest. An altercation with the OPP is alleged to have ensued. Four
Mohawks were then arrested and jailed. The OPP were reported to have
drawn their guns on the Mohawk community members remaining the quarry.

According to Mohawk spokesperson Jay Maracle, "The OPP led us into
this incident by jumping five of our men, arresting them and taking
them to jail and then sticking guns in our faces, in women and
children's faces," he said.

There has been open communication between the Mohawks and the OPP but
Maracle said things will not improve unless OPP retracts a statement
indicating there are armed Mohawks at the quarry. He said there are no
guns at the site.

Matt Kunkel, Clint Brant, Dan Doreen, and Steve Chartrand remain in
custody and will appear in bail court in Napanee today. The group
includes Dan Dorene, spokesperson for the Mohawk blockade on Highway 2
one week ago, erected to prevent development on the Culberston Tract,
land which rightfully belongs to the Mohawks.

A couple from the community who were also arrested by the OPP on
Friday were later were released unconditionally.

Shawn Brant will also likely appear in court today.

This brings the total number of First Nations people in Ontario jails
for defending their land to 12.

Ontario Jails Five More First Nations People Involved in Land Struggles

(Sunday, April 27, 2008 -Tyendinaga Mohawk Territory) Five men from
Tyendinaga are in jail today bringing the total number of First Nations
people in Ontario jails for defending their land to 12.

Ontario, it appears, has opted for the incarceration of First Nations
people over the resolution of outstanding land issues as their status quo.

As for the Ontario Provincial Police, it appears the adoption of Justice
Linden's Ipperwash Inquiry recommendations is experiencing some delay.
While in custody at the Napanee Detachment several different officers
repeatedly informed Shawn Brant that they were going to "slit his throat"
and that he was a "dead man."

This followed a similarly disturbing incident that occurred on Monday,
April 22nd during the road closures in Deseronto when an officer on the
scene clearly and audibly commented to her colleagues "we should just
shoot them (Mohawks) all."

Meanwhile, road closures continue in Tyendinaga and Six Nations until, as
one man said, "We finish the job."

MOVE 9 Women Denied Parole!

The Philadelphia Inquirer ( READ FULL ARTICLE ) announced today that the three remaining MOVE 9 women (Debbie Sims Africa, Janet Hollaway Africa and Janine Phillips Africa) were denied parole by the PA Parole Board. The Inquirer quotes parole board spokesperson Leo Dunn as saying that parole had been denied on the grounds that the three MOVE prisoners had “minimized or denied the ‘nature and circumstances’ of the offense, ‘refused to accept responsibility’ and lacked remorse. He said the fourth reason for the rejections was the ‘negative recommendation’ by the prosecutor.”

The parole board used several of the stipulations that MOVE spokesperson Ramona Africa had predicted that they would try and use to deny parole, including that they "refused to accept responsibility" and lacked remorse.... The unfairness and arguable illegality of this is so obvious, because how can you expect someone to "admit guilt" when they've always said they are innocent? Where does remorse come from if someone is actually innocent?

The “nature and circumstances” stipulation is a blatant re-sentence, since the serious nature of the charges were considered by the judge at the time when he ruled that MOVE should be eligible for parole after 30 years. How can this fairly be used to deny parole?

A further outrage is that the women never even faced weapons charges, unlike the male MOVE 9 prisoners. Because of this, it had been thought by many observers that the women would have a better chance of receiving parole.

Therefore, if this is any indication, it does not look good for the MOVE 9 men, for whom the parole decision is still pending. If supporters want to make a difference and hold the parole board accountable for these blatantly unconstitutional parole stipulations, we must increase public pressure.

This blatantly unfair decision can only serve to validate the argument that the MOVE 9 are indeed “political prisoners”.

Daniel McGowan is an environmental and social justice activist. He was
charged in federal court on many counts of arson, property destruction and
conspiracy, all relating to two incidents in Oregon in 2001. Until
recently, Daniel was offered two choices by the government: cooperate by
informing on other people, or go to trial and face life in prison. His
only real option was to plead not guilty until he could reach a resolution
of the case that permitted him to honor his principles. As a result of
months of litigation and negotiation, Daniel was able to admit to his role
in these two incidents, while not implicating or identifying any other
people who might have been involved. He was sentenced to 7 years in prison
on June 4, 2007 and began serving his time on July 2, 2007.

America's Gulag Just Keeps Growing

We're No. 1! We're No. 1! The New York Times' Adam Liptak wrote a disturbing front-page story on Wednesday about how the United States dwarfs the rest of the world when it comes to locking up its citizens. The United States has less than 5 percent of the world's population, but a quarter of the world's prisoners. There are now 2.3 million people behind bars in the United States. According to the Justice Department's Bureau of Justice Statistics' most recent report, the number of people incarcerated in U.S. prisons and jails jumped by more than 60,000 in the year ending June 30, 2006. That jump represents the largest increase since 2000.


The United States continues to rank first among all nations in both total prison/jail population and per capita incarceration rates. The United States has held first place for decades, followed by China (with more than four times our population) at 1.6 million and Russia at 885,670, according to the International Centre for Prison Studies at King's College in London.


America's prison population explosion is fed in good part by the failed drug war policies of the past 30-plus years. Back in 1980, around 50,000 people were incarcerated for drug law violations. The total is now roughly 500,000. And this number does not even include hundreds of thousands of parolees and probationers who are incarcerated for technical violations, such as a drug relapse, nor does it include nondrug offenses committed under the influence of drugs, or to support a drug habit, or crimes of violence committed by drug sellers.


The Liptak piece describes criminologists and legal scholars in other industrialized countries as being mystified and appalled by the number of Americans incarcerated and length of the prison sentences. "The U.S. pursues the war on drugs with an ignorant fanaticism," said Vivian Stern, a research fellow at the Centre for Prison Studies at King's College in London. In the past Europeans came to America to study the prison system, but now they look at U.S. policies to see what not to do.


Two powerful forces are at play today. On the one hand, public opinion strongly supports alternatives to incarceration for nonviolent and especially low-level drug law violators -- and state legislatures around the country are beginning to follow suit. The paramount example to date is Prop. 36, the Californian "treatment instead of incarceration" ballot initiative in 2000 that won with 61 percent of the vote notwithstanding the opposition of political and law enforcement officials. On the other hand, the prison-industrial complex has become a powerful force in American society, able to make the most of the political inertia that sustains knee-jerk, lock-'em-up policies. There are some prosecutors quoted in the Times story who try to spin the draconian sentences as the byproduct of democracy: that elected officials are just responding to their constituents' desire to lock up the bad guys and throw away the keys. There's no doubt some truth in this, but far more insidious is how many politicians exploit fears about drugs to make themselves look "tough on crime.

Voters should be outraged that their tax money continues to be wasted on failed drug war policies. It's time for a change.


Despite hundreds of billions of dollars spent and millions of Americans incarcerated, illegal drugs remain cheap, potent and widely available in every community; and the harms associated with them -- addiction, overdose, and the spread of HIV/AIDS and hepatitis -- continue to mount. Meanwhile, the war on drugs has created new problems of its own, including rampant racial disparities in the criminal justice system, broken families, increased poverty, unchecked federal power and eroded civil liberties. Our elected officials need new metrics to determine whether progress is being made.


It's time for a new bottom line for U.S. drug policy -- one that focuses on reducing the cumulative death, disease, crime and suffering associated with both drug misuse and drug prohibition. A good start would be enacting short- and long-term national goals for reducing the problems associated with both drugs and the war on drugs. Such goals should include reducing social problems like drug addiction, overdose deaths, the spread of HIV/AIDS from injection drug use, racial disparities in the criminal justice system, and the enormous number of nonviolent offenders behind bars. Federal drug agencies should be judged -- and funded -- according to their ability to meet these goals.

Washington State Opens Environmentally-Friendly Control Unit

In October 2007, the Monroe Correctional Complex (MCC), Washington
State's largest prison, opened the first prison building in
Washington State to be certified as "green" by the U.S. Green
Building Council. The unit, a new segregation building with 200
bunks, consists of a 100-bunk Intensive Management Unit (IMU) for
prisoners who are placed there at the whim of prison officials for
indefinite, long term stays and a 100-bunk unit for prisoners
spending a shorter period in segregation.

At 2,500-bunks, not including the new segregation building, MCC is
Washington State's largest prison. Located 45 minutes from Seattle,
overcrowding has long been an issue at MCC. Relatives of prisoners
claim that the crowded conditions led to violence, including the
murder of several prisoners.

The new segregation building cost $39.5 million. The price tag
included a rainwater collection system for toilet-flushing water and
low energy lighting.

The Washington State Legislature passed state laws requiring that new
prisons be energy efficient even though construction costs of such
prisons are higher than those of conventional prisons. Thus, the new
"green-rated" 2,048-bunk prison unit at Coyote Ridge will cost $254
million. However, according to Washington Department of Corrections
(DOC) officials, the extra cost will pay for itself in the long run
by reducing operating costs. Of course, this assumes things turn out
as planned. PLN has previously reported on the shoddy construction of
other Washington state prisons that resulted in millions of dollars
of repairs.

"It costs a little bit more to build," said David Jansen, head of the
DOC?s capital programs. "But over the life of the building it ends up
costing less" in utilities and maintenance costs.

The new control unit follows the typical pattern of other Intensive
Management Units in Washington state. Prisoners are locked in their
8-by-12-foot cells 24-hours a day, with a nominal one hour of
?recreation? outside the cell five days a week. They are allowed
15-minute showers three times a week. Prisoners are observed 24 hours
a day from an elevated, hi-tech control room and the 172 security
cameras, placed throughout the 77,000-square-foot building. Prisoners
are limited to six months in the segregation unit, but can stay in
IMU indefinitely.
The only difference in how the two are run is that IMU prisoners are
allowed a TV and a radio.

Allison Parker, deputy director of Human Rights Watch, described
solitary confinement as ?cruel and unusual punishment.?

?Solitary confinement has the obvious effect of reducing social
contacts between offenders ... and can have lasting psychological
effects on human beings,? according to Parker. ?It should be a
measure of last resort.?

Unfortunately the DOC and many other prison systems, use solitary
confinement as the preferred option for prisoners who don?t kowtow to
the system. In addition to confining some incorrigibly violent or
vulnerable prisoners, it is often used to discourage prisoner
journalists and jailhouse lawyers from exposing the evil inherent in
the American way of imprisonment. PLN editor Paul Wright observed
that during his imprisonment he wound up in many of Washington
state?s IMUs in retaliation for his writing and litigation. ?Built at
great expense, Washington fills its IMUs with prisoners accused of
minor offenses and the mentally ill,? Wright said. This is the
seventh 100 cell IMU Washington has built since 1984 when it opened
its first one. Likewise, in many states costly prison expansion
project are touted while inexpensive rehabilitation programs languish
underfunded.

Washington State is currently in the midst of a $500 million prison
expansion program which will result in new units being built at
Coyote Ridge Corrections Center, the Washington State Penitentiary,
Larch Corrections Center, Cedar Creek Corrections Center, Airway
Heights Corrections Center and Mission Creed women?s prison. The
3,500-bunk expansion program is scheduled for completion by 2009.
Despite the program, DOC officials predict a 4,000-bunk deficit
within a decade.

?We don?t think you can outbuild the inmate population,? said
assistant deputy of prison departments Mike Kenney. ?It?s kind of a
?Field of Dreams? syndrome.?

According to Kenney, a better solution is the $25 million re-entry
program tailored to reduce recidivism.

?The whole purpose of re-entry is to turn back the tide so we don?t
keep building new prisons,? said Kenny. ?We don?t believe that
building is a long-term solution.?

Nice words, retort prisoner advocates, but put your money where your
mouth is instead of funding recidivism reduction programs at 1/20th
the rate of construction projects funding.

?They do these little piecemeal things,? said An Kohn, advocate for
improved educational, and transitional housing programs. ?It?s
ridiculous, and it comes out of cowardice. All of these legislators
are just scared to death at being labeled soft on crime.?

Unfortunately, whereas the legislature seems perfectly capable of
understanding long-term payoffs when it comes to green building
construction, it seems to lose that long-term perspective when
rehabilitation programs are proposed. The greenest prison is an empty
one. However, until law-making bodies throughout the country come to
value and appreciate the practicality of rehabilitation programs, we
are likely to continue with record-breaking prison populations and
prison-building booms. The building of ?green prisons? also
illustrates how easily co-opted the rhetoric of environmentalism is
for destructive and repressive purposes.

Marie Mason was arrested and charged with ELF activities in Michigan
dating back almost a decade. As many of you already know Marie has since
been released on an unsecured bond and has been under house arrest for
over a month now awaiting trial. Marie's attorney petitioned the court to
serve her house arrest in her own community of Cincinnati, OH, where her
young daughter, close friends, animal companions, and support crew are
located. The court denied her request citing she "did not have sufficient
property interests in Cincinnati". She is required to serve her house
arrest in the western district of Michigan.

While house arrest is no where near as bad as incarceration it still has
its own bag of stresses and hardships. We are encouraging folks to
continue to send Marie letters of support. House arrest does not have any
silly jail rules like what type of ink or paper you use so get creative.
Letters, Photos, Art, videos, collages, vegan baked goods and vegan
recipes are all welcome. Email letters of support are also welcome and can
be sent to freemarie@riseup.net and will be forwarded to Marie.

We want to be clear though Marie's needs and isolation in this respect are
not as pressing as some of the other Green Scare prisoners who are

Secondly, anyone that doesn't know me will not yet understand how
appalling I am at corresponding. I do put pen to paper when my box of
"letters to reply to" begins to spill over. However, more often than not

Thirdly, I am continuing to correspond with those I have started with
and must add I shall continue to "trouble" the VPSG with endless chores

In September 1998, thousands gathered in Berkeley, California, for
conference that founded Critical Resistance’s movement to abolish the
prison industrial complex (PIC). Each participant, with their own
experiences of oppression and resistance, watched as diverse struggles
were unified: by humanity, hope, and the shared vision of a different
world. We witnessed a vision of a world with truly safe, healthy, and
whole communities; a world with unconditional access to self-determination
and dignity for all; and, critically, a world without imprisonment,
policing, and other forms of punishment and control.

To celebrate 10 years of Critical Resistance, thousands will converge once
more, September 26-28, 2008, in Oakland, California, for CR10, a 10th
Anniversary Celebration and Strategy Session.

Over the past decade, the movement to eliminate the PIC has faced
tremendous challenges. We have witnessed rising levels of imprisonment in
the US and around the world. We have endured passage of the USAPATRIOT Act
of 2001, the Military Commissions Act of 2006, increasing surveillance and
policing in our lives. Meanwhile, US-led wars continue to ravage
communities around the globe. We have witnessed the increased repression
and criminalization of migrants and immigrants, people of color, young
people, and queer communities. We have seen California prepare to embark
on the biggest prison building project in history as the Gulf Coast region
continues to struggle and to prevail in spite of ongoing neglect and
militarization.

During this period Critical Resistance has also developed into a leading
force fighting against the use of imprisonment, policing, and surveillance
as responses to social, economic, and political problems. During the past
10 years we have:
• Brought the idea of the prison industrial complex (PIC) into mainstream
conversations;
• Substantially increased collaboration of PIC abolitionists with
organizers in environmental justice, anti-violence, and queer movements;
• Promoted prisoners, former prisoners, and their loved ones as the real
experts on the system;
• Provided a platform and jumping off point for new organizations and
organizing efforts; and
• Contributed to dozens of local and regional victories across the country.

We have seen only the beginning of what we can accomplish together. CR10
promises to propel this momentum forward, with united, strategic force.

SEATTLE –On Thursday, April 24th, more than 100 students will participate in a hunger strike in solidarity with Sami Al-Arian and his struggle for justice. A broad coalition of student organizations on the University of Washington campus have come together in solidarity with Sami Al-Arian.

The hunger strike will conclude at 6PM with a showing of the film, USA vs. Al-Arian, and a humble meal in Smith Hall, RM 205 on the campus of the University of Washington Campus.

Sami has been on a hunger strike since March 3, 2008. For the first 18 days, he abstained from both food and water. Since then, he has only taken water. He has lost 35 pounds and his life is in danger. His release is requested not only on legal grounds, but humanitarian grounds as well. This case has drawn international attention and has dealt a severe blow to the United States of America's domestic human rights record. Dr. Al-Arian is the most prominent political prisoner in the United States and the only one currently on a hunger strike.

In February 2003, the FBI raided the home of University of South Florida professor Sami Al-Arian and arrested him in front of his wife and children. Al-Arian was then charged with 17 counts related to terrorism. Many government officials, including then-Attorney General John Ashcroft called Al-Arian a leader in the Palestinian Islamic Jihad and made claims that he was raising funds to support terrorism.

The film, USA vs. Al-Arian tells the story through family interviews, news footage, and attractive animation while providing enough detail and context to the illegal incarceration. USA vs. Al-Arian tells not just the story of Sami Al-Arian, but of plight of the Palestinians and of the erosion of civil liberties in the post-9/11 United States.

Junk Bonds to Junk Science? Drug Treatment Program Questioned

What was worth approximately $554 million in 2007 and is valued at about $94 million today? The correct answer is the stock market value of a firm formerly known as Alaska Freightways Inc., a shell company that, as the result of a merger, is now doing business as Hythiam, Inc.

According to a corporate profile on its website, Hythiam “offers initial disease management offerings for substance dependence built around its proprietary PROMETA Treatment Program for alcoholism and dependence to stimulants.” Basically, the company's primary pharmaceutical product, Prometa, is being marketed for the treatment of various drug addictions – including alcohol and methamphetamine abuse.

However, buyers may want to beware. Hythiam notes that “Clinical studies are under way to evaluate the PROMETA Treatment Program and to confirm reports from physicians providing the PROMETA Treatment Program in their practices.... The medications used in the PROMETA Treatment Program are Food and Drug Administration (FDA) approved for uses other than treating dependence on alcohol, cocaine or methamphetamine. Therefore, the risks and benefits of using these medications to treat dependence on these substances have not been evaluated by the FDA.”

Their cautionary statement has not deterred drug court programs in six states from trying Prometa; indeed, the corrections system is a huge market for addiction treatment. In one of Hythiam's annual reports, the company noted that it could potentially treat up to 5 million people in criminal justice programs. Prometa has also been marketed heavily to the general public.

What is Prometa? It's a 30-day treatment regimen that includes the use of three powerful prescription drugs. The drugs are gabapentin, an anti-seizure medication, flumazenil, which is used as an antidote in the treatment of benzodiazepine overdose, and hydroxyzine, an antihistamine. The Prometa protocol costs approximately $15,000 per participant and has been touted as a revolutionary cure-all for a myriad of addictions. The company cites numerous success stories, which have been echoed by some doctors and substance abuse treatment programs.

However, the hype created by Prometa may have cost a local Texas judge his elected position. Twelve-year incumbent judge Charles J. Sandoval, of the 380th Judicial District Court in Collin County, lost the Republican primary in March 2008. He had started a Prometa pilot program, funded by Hythiam, that involved 20 probationers.

Judge Sandoval was interviewed by the Plano Courier Star in January 2008 and made the following statement about Prometa: “It only takes about a month to go through the program and it runs about $15,000. The result of my pilot program is that the state of Texas, in the last legislative session, allocated $2 million to this sort of treatment. That $2 million is going to be dispersed throughout the state and Collin County is going to get its fair share of that money.”

In fact, Collin County received $185,000 for Prometa funding. Three other Texas counties, Lubbock, Caldwell and Nueces, received lesser amounts ranging from $100,000 to $154,000. The local programs made participation in the Prometa protocol a requirement for certain offenders placed on probation.

On the Collin County Observer news blog, author Bill Bumbaugh noted that Sandoval’s website reportedly claimed the Prometa trial program had saved the county $400,000. Upon inquiry from Bumbaugh regarding this claim, Sandoval’s office stated it had "no records of the Prometa pilot program." One of the participants had died during the program; the death was recorded as a suicide.

Like swift Texas justice itself, Emily Ramshaw published a story in the January 20, 2008 edition of the Dallas Morning News that criticized the allocation of funds for, and questioned the credibility of, the Prometa protocol. Ramshaw noted that $2 million was appropriated by the Texas legislature with “little notice or objection for an obscure medical treatment.”

In the article, Dallas Criminal District Judge John Creuzot opined, “I don't think anybody should be spending any amount of money on something that hasn't been clinically researched to be safe and effective." He said the company that marketed the treatment was "in the business of making money, and they did a great sales job on some well-intended legislators in Texas."

Judge Creuzot refused to adopt the Prometa program in his district. In addition, Kathryn Cunningham, director of the University of Texas Medical Branch's Center for Addiction Research, acknowledged that while it's true some treatments can alter brain chemistry and curb drug use, no evidence indicated that Prometa was one of them. "There's been a lot of marketing hype before the evidence exists. This is not something I'd personally want to spend my taxpayer money on," she said. "I know a lot of scientists in this area, and we're all singing the same tune.... This is misguided."

Lori Karen, a researcher with the Drug Dependence Research Laboratory at the University of California San Francisco, concurred. "The marketing is way ahead of the science," she noted.

Texas was not the only state to hire Hythiam in an attempt to reduce drug addiction. In 2006, Washington State's Pierce County committed to spend $489,000 on Prometa treatment. A study of the drug court program conducted for the Pierce County Performance Audit Committee concluded, “While Hythiam claims the Prometa protocol has been exceptionally successful the foregoing analysis indicates that the results of the 2006 ... pilot study do not surpass results normally found in drug court settings.”

The audit found the pilot program didn't factor in no-shows for drug tests or participant drop-outs when calculating successful program completion statistics, and that some program graduates still tested positive when checked for drug use. "It's clear to me that we are much more involved in a marketing scheme … rather than testing real results," remarked Pierce County Councilman Shawn Bunney.

Additionally, the Tacoma News Tribune reported that some public officials who had requested funding for the Prometa pilot programs in Washington had either failed to disclose or understated their Hythiam stock holdings.

Pierce County's Prometa program was subsequently discontinued in late 2007, although the county appropriated funds to finish the pilot program with its existing participants and to conduct a Prometa study at the University of Washington.

The Pierce County audit report had also criticized Hythiam's corporate marketing description of Prometa programs, and noted various examples where the company's statements were incorrect or not entirely candid.

A Feb. 2006 Hythiam news release referenced a 30-patient trial program in Idaho. There was no such pilot program. According to Judge Ron Wilper, a member of the Idaho Drug Court Coordinating Committee, "they wanted us to partner with them so they could put out a press release." The Coordinating Committee declined to use Prometa, as it was not FDA-approved and not supported by unbiased clinical studies. "We’re hicks, I grant you that,” said Judge Wilper. "But we didn’t just fall off the turnip truck."

Hythiem also touted a November 2005, 20-person study in Gary, Indiana as a success story – and indeed, program officials, including Drug Court Judge Deidre Monroe, endorsed Prometa's efficacy. However, the drug court refused to release any data about the study, citing privacy laws. Also, a court case manager stated in Oct. 2007 that only 43 percent of the Prometa program participants were "still clean."

Interestingly, on July 10, 2007, Karen Freeman-Wilson joined Hythiam's board of directors. Freeman-Wilson, a former Indiana Attorney General and former judge who had presided over the Gary, Indiana drug court, was listed as having "coordinated" the Prometa pilot program. She is also a former CEO of the National Association of Drug Court Professionals. According to an SEC filing, the month after she joined the company she reported owning 100,000 shares of Hythiam stock.

In Feb. 2006, a Hythiam press release cited a planned pilot program in Covington, Louisiana that involved the 22nd Judicial District Court, where Judge Peter Garcia ran a drug court. “It never got to that point,” Judge Garcia said. “The study was never done. Nothing was ever developed.”

A Prometa trial program was initiated in Fulton County, Georgia in December 2006. According to Hythiam, the trial was to include 20 participants in conjunction with the Fulton Co. Superior Court. The program ended after only three months; just four participants took part. Court spokesman Don Plummer stated, “We discontinued the program because it had not been effective for our Drug Court defendants," and said "We do not plan to use the program in the future.”

Most recently, in April 2008, city officials in Federal Way – located just northeast of Tacoma, Washington – unanimously decided to cancel a trial Prometa program before it started. The city had approved $20,000 to fund the program last November, but then had concerns about the lack of scientific proof that the drug treatment regimen actually worked. "The more we learned the more we became concerned whether this was an appropriate use of the city’s resources," stated City Council member Jim Ferrell.

Other jurisdictions are experimenting with Prometa, including a Municipal Court in Las Vegas, Nevada. Others have turned it down, including drug courts in King, Snohomish and Thurston Counties in Washington State.

The use of Prometa to treat drug addicts, absent approval from the FDA, amounts to Phase I or Phase II clinical trials on human test subjects. Because Hythiam is privately funded, the Office of Human Research Protections (OHRP) has no jurisdiction under current regulations to protect the program participants or monitor such studies. Hythiam has created the perfect storm – drug addicted test subjects under court-ordered supervision with no OHRP oversight, and overzealous and sometimes financially-conflicted public officials "hyping" the company's non-FDA approved treatment protocol.

Hopefully the CEO of Hythiam, Terren Peizer, a former junk bond salesman and executive at Drexel Burnham Lambert during the Michael Milken scandal era, is not selling “junk science” as well. Hythiam's stock, which has traded as high as $9.00 a share within the past year, is presently valued at less than $1.80 per share. According to MorningStar, an independent investment research firm, "Over the long haul, this company has posted some of its industry's worst returns on assets." Hythiam has generated a net loss each year for the past 5 years.

Only time – and independent, objective large-scale clinical testing – will tell if the Prometa treatment being pushed by Mr. Peizer is like the junk bonds he once sold: worthless.

The Los Angeles City Council has unanimously endorsed a resolution
calling for former Symbionese Liberation Army member Sara Jane Olson
to remain in prison for the remainder of her sentence.

The resolution, approved on a 15-0 vote Wednesday, also calls for
Olson to serve a potential parole term within the state, according to
a news release from the Los Angeles Police Protective League.

Olson was paroled March 17 after serving half of a 12-year sentence
for the attempted bombings of two Los Angeles police cars in 1975 and
for acting as the getaway driver in a fatal bank robbery in which a
Carmichael woman, Myrna Opsahl, was killed the same year.

Olson was intercepted at Los Angeles International Airport as she
prepared to fly back home to Minnesota and then re-arrested after
state prison officials said they had miscalculated her release date.

A motion filed in Sacramento Superior Court by her lawyers claims
Olson's due process rights were violated when she was returned to
prison to serve at least another year behind bars. Her lawyers say
that Olson should be freed from prison because corrections officials
had no authority to re-arrest her.

A Benefit for Marie Mason

Marie Mason is a school teacher in Cincinatti, Ohio, a long-time
environmental and labor union activist and a loving mother of two. On
March 10th, Marie was arrested by FBI, Homeland Security, and local police
and charged with the destruction of logging equipment related to an
incident in Michigan in 2000, and another incident in 1999 related to an
arson at Michigan State University.

This is one of the more recent developments, in what many have dubbed the
Green Scare, a recent wave of repression aimed at disrupting and
discrediting grassroots environmental activism and criminalizing dissent.

On February 28th, 2008, my friend and political prisoner Jeff ‘Free’ Luers received his long-awaited sentence of 10 years by Judge Billings in Eugene, Oregon. This outcome was a long time coming— Jeff was arrested in June 2000, sentenced June 2001 and his appeal was filed January 2002. February 14, 2007 saw his sentence of 22 years and 8 months, imposed by Judge Lule Velure, thrown out. After waiting for so long and my belief that this so-called justice system could be fair long eroded, I doubted I would ever see any victory with Jeff’s case.

Jeff was sentenced to an absurd sentence of nearly 23 years back in 2001 which many saw as a clear message to the movement: use property destruction as a tactic and you will be crushed. It was a message heard loud and clear just a few years later when my co-defendants were indicted in the Operation Backfire/ELF case initially charged us with crimes that could have put us behind bars for life.

I knew Free from the Eugene anarchist scene— at the time a thriving and active smattering of collectives, groups and spaces. Free did Food Not Bombs and taught self defense. We were both involved in an 8-week activist gathering called Eugene Active Existence and had mutual friends. My interactions with him were always positive and I respected his participation in the Fall Creek tree village— a tactic/style of campaigning I had become disenchanted with. When Jeff was arrested, like many of the local anarchists, I joined efforts to support him and fundraise for his legal defense. Ironically, at the same time, I was involved with the Earth Liberation Front and was participating in actions similar to what Jeff was arrested for.

Hindsight is 20/20, of course, so perhaps it’s easy to say this now. Either way, events outside of Jeff’s (or my) control heavily impacted his life and legal case. Some of my co-defendants went back to Romania Chevrolet’s, in an apparent gesture of solidarity, and burned 36 SUVs in an immense and spectacular action. The second Romania arson (“Romania II”) was polarizing to say the least. Some in the activist community freaked out thinking it was a COINTELPRO-inspired set-up specifically designed to ruin Jeff’s trial. The corporate media in Eugene (specifically the Register Guard and Oregonian) offered sensational coverage implying links between Jeff and the incident.

In this climate, Jeff made the decision to have a bench trial— without a jury. The Judge would not only give the sentence (per usual) but would decide guilt or innocence. Despite major holes in the government’s arguments, the Judge (Lyle Velure) found Jeff guilty on 11 of 13 charges— including counts related to an attempted arson at Tyree Oil (an action Jeff has stated he was not involved in). Jeff was found guilty of 3 1st-degree counts of arson— one for each vehicle— which carried 7-year mandatory minimum sentences. When all was said and done, Velure handed Jeff a 22-year, 8-month sentence and Jeff was sent to a maximum security prison. It’s where he has done much of his time since that day.

There has been a lot of speculation on the impact of Romania II on Jeff’s sentence. Suffice to say, I think the action had a clearly negative impact on Jeff’s state of mind regarding his ability to win at trial, inflamed the Judge and the Romania family and polluted the potential jury pool. Everyone knew about this action in the small city of 150,000. Of course the media’s role in this is obvious but they are just doing what they do and it’s silly to assume they would do anything else [case in point, the smoke hasn’t cleared at the Woodinville, WA fires that took place at a rural development before the media and law enforcement proclaimed it an ELF action. The impact on the Briana Waters’ trial is widely assumed to have been negative.]

It is my belief that our movement(s) need to not shy away from discussions of these situations. Criticism, when done in the context of support and respect, is appropriate. It can help us move forward and give us a decent perspective on our own actions. As evidenced by the Woodinville fires (assuming it is ELF), it is apparent that we haven’t learned our lesson. Suspending any sort of discussion on whether the radical environmental movements should use arson, the question of timing and impact on others is still there. It was foreseeable, in my opinion that the second Romania arson was going to inflame and polarize Jeff’s legal situation. To see this situation (potentially) play out years later is just sad. While I know the intentions of those who did Romania II were good, we still need to face up to the impact of these actions.

Although my participation with the Romania II arson was limited to being shown the communique (and failing to have Jeff’s name removed), I felt partially responsibility. The repercussions of that action hit home for me and I decided I needed to be responsible for Jeff’s sentence. I committed to being there for him in the long haul, through every appeal and ordeal until he was released. From 2001- my arrest in December 2005, I was lucky enough to work with a variety of activists all over the world in fighting for Jeff’s freedom. Specifically, the Luers family, Break the Chain and the Friends of Jeff Luers crew were the stand-outs of that effort.

Almost 8 years later after many legal briefs, multiple prisons, a few trips to the hole, 3 international days of action/weekends of resistance and countless interviews, dispatches, articles and videos, we won. Jeff is coming home in December 2009 provided he participates in a boot camp program. While I am pissed off that Jeff wasn’t released immediately, as he should have been, I am happy he will be getting out at age 30, not 43!

Our prisoners have not always done so well upon release and have had a hard time adjusting to outside life again. It is imperative that we resolve to support people not just while they are imprisoned but in the period of adjustment when they re-enter society.

The Irish republican movement has a group called ‘Welcome Home’ (translated from Irish) that exists to provide support released political prisoners beyond the initial rush and euphoria from release. This work isn’t glamorous but it’s necessary. Finding decent housing and jobs, helping people comply with parole and probation, setting them up with clothes and some money when they get out— these are all things our communities can and should do. Jeff luckily has options in all these areas due to the hard work of activists in Eugene. He plans to go to school for green building or ecological sciences. He also plans to spend a lot of time with family and friends. His future indeed does look bright.

For me, I’m just excited my friend is coming home. While I will not be able to see him until 2015, due to my probation, its a day I look forward to. Free’s coming home— damn, that feels good to say.

Solidarity Statement for Mumia from Leonard Peltier

To Mumia Abu-Jamal -- my brother in this Struggle; and your family,
friends, and supporters.

I offer you my warmest greetings. How appropriate, after so many
years, that I now send you word from a cage housed in the very same
state as yours.

Perhaps it is destiny that we would find ourselves incarcerated so
near, under similar circumstance, by similar forces, using similar
excuses, for a similar love of our people.

Perhaps it is destiny that we arrived at a similar truth -- that we
had to stand in opposition to a similar oppression.

Perhaps it was destiny that we were unable to stand idly by with
similar brutality all around us, and similar violence thrust upon us,
as the only means to survive.

Given the choice of lying down to die or standing up to live, we chose
to live. Standing up and living is our only crime in this, the land
of the free and home of the brave. Our dream is still alive, and as
hunger striker Bobby Sands once said, you can lock up the dreamer but
you cannot place chains around an idea.

While acknowledging another setback for Mumia in the lack of a new
trial, I am hopeful for the new sentencing hearing on April 19. Like
so many before us, our smaller victories will one day result in our
ultimate triumph, and we will carry on the Struggle until that day.
For we are one, and we are many. We are forever, we are timeless. We
are Crazy Horse, we are Geronimo, we are Mumia, we are Leonard
Peltier, we are Malcolm X, and we are Martin Luther King. We are the
voice of justice and natural living. We are the American Indian
Movement, we are the Black Panthers, we are MOVE, we are the Viet
Cong, we are the Irish Republican Army, and the Palestinian Liberation
Organization.

We are every man, woman and child who desires to see a sunrise in a
land of freedom and opportunity, a land of plenty and not hunger, a
land of choices without fear, a land of progress without brutality.
We are not only the citizens of Belfast and Pine Ridge, Philadelphia
and Gaza. We are children of Earth, a place worth living in and not
just surviving in. A place where every life, no matter if it is
wrapped in brown skin or black, red skin or yellow, white skin or any
color skin, is precious to our God and to each other.

I pray and I live for the day that we meet as free men, and embrace
each other in our own communities, with our families and the world as
witness to our liberation and our triumph. For make no mistake the

Who is Jonathan Paul and Why Does He Need Support Right Now?

Jonathan has been an animal and environmental activist since the 1980s and
a vegan for 25 years. He and his wife live with 5 companion animals off
the grid, powering their home with solar panels. Jonathan is currently
serving a 51 – month sentence in federal prison in Phoenix, Arizona for
his role in the 1997 arson of the Cavel West horse slaughterhouse in
Redmond, OR.

Jonathan has dedicated his life to protecting the earth and alleviating
the suffering of animals, human and non-human. From 1999 until the time he
reported to prison in October of 2007, Jonathan served his community as an
Emergency Medical Technician and volunteer firefighter. Jonathan has

New information has recently been obtained on FBI informant Frank Ambrose. Ambrose has already plead guilty and agreed to help the government and their investigation of ELF/ALF actions in any way.

Court documents reveal that Ambrose was being used by the FBI not only to gather information on ELF/ALF activities but general movement organizing as well. Specifically I-69 organizing and Cincinnati Earth First! organizing.

We have confirmed there is an active Grand Jury out of Grand Rapids, MI. Recently released court documents suggest Ambrose has provided information on "15" other people allegedly involved in ELF/ALF actions.

Page 9 of 13 number 12 reveals CS-1 (believed to be Ambrose) has provided information to the government on a large number of people. Its important to remember that Ambrose is providing info on others to save his own skin. Anyone involved in any type of movement organizing who has come in contact with Ambrose in the past year should be weary. We do not have these names. "12.CS-I's proffer statement provided intricate details on Ambrose and Mason's direct involvement in over 20 acts of animal rights terrorism and eco-terrorism. These acts were committed within the states of Indiana, Michigan, and Virginia during the aforementioned time frame. CS-I reported the majority of the incidents were "officially" claimed by utilizing anonymous e-mail and/or letter communications through the ELF's press office. In addition to providing details regarding his/her knowledge and/or involvement in these direct actions, CS-I identified an additional 15 ELF adherents who assisted in the commission and/or planning of these events."

We would like to remind everyone that they are under no obligation whatsoever to speak with law enforcement under any circumstances and should never do so without the presence of an attorney. Additionally, if you do choose to speak to law enforcement, and are found later to have been untruthful in any way, this constitutes basis for criminal prosecution. Its perfectly legal for law enforcement to lie to you but it is a criminal act for you to lie to them.

date, Eric's lawyer attempted to set it for April 24, but was unable to do
so because Judge England will be getting married next week. In lieu of
wedding gifts, we're asking that folks make a small donation to Eric's
commissary fund to help his transition to federal prison. When he moves
to a federal facility, his commissary account will move with him. If he
has money in his account when he arrives, he will be able to purchase the

JTTF "Little Green Scare" comes to DC area at circus protest in VA

An animal rights activist was arrested on FELONY charges by the FBI

at protests of the Ringling Brothers circus at the Patriot Center,
George Mason University, in Virginia near DC.

This is the latest and most serious in a string of suspicious arrests, all but one of animal rights activists, in the DC area. The JTTF involvement solves a lot of mysteries concerning harassment of activists in this area.

Due to both the pattern of arrests and severity of this latest case, we've got a "mini Green Scare" right here in the DC area. Since FBI agent Vinvent Antignano, badge #1035(the one involved Friday) and his buddies are based in Prince William County(and also involved in anti "gang" and other roundups of immigrants by the FBI, we know where they get their ideas.

While this does not rise to the level of the massive raids and deportations of immigrants around here(no doubt contrary to Vinvent's wishes!), nor to the decades in prison faced by Green Scare defendants elsewhere, the possibility of 9 months in a VA jail hellhole is nothing to sneeze at-and that's what's at stake in this latest case.

Here's the kicker-GMU students protesting WITHOUT masks have bee subject to campus "discipline" that can include expulsion, while masked protesters are treated as "terrorists" and prosecuted on felony charges. The effect of this is to ban ALL protest at the circus, in clear contravention of the right of free speech.

This kind of thing creates an incentive to replace speech(where cops have time to respond) with direct action(where they do not when groups like the ALF deploy at night).

In fact, this case and previous cases at HLS demos fit the time-honored pattern where ALF et all put points on the board and never get caught, so cops arrest above-ground, legal protesters instead, like they just did in Virginia.

One final point-at previous HLS demos, when I chased Vinvent Antignano with my camera, he ran like a rabbit pursued by howling wolves!

FBI Agent Arrests Animal Rights Activist at George Mason University

On Saturday, April 12, an FBI agent arrested an animal rights activist at George Mason University in Fairfax, VA. The activist was charged with wearing a mask in public—a Class 6 felony in Virginia.

On April 5, the arrested activist attended a protest at GMU and wore a mask. After the GMU Police Department identified the activist, a warrant was issued for his arrest. When he appeared at a protest one week later, he was identified and subsequently tackled and arrested. The arrested activist was protesting Ringling Brothers and Barnum & Bailey Circus for their history of animal abuse.

The FBI agent who arrested the activist is part of the Joint Terrorism Task Force and is based in Prince William, VA. His name is Vincent Antignano and his badge number is #1035. He was stalking the arrested activist after he protested on numerous occasions against a private company, Huntingdon Life Sciences, which conducts medical tests on animals.

The activist was arrested for violating Virginia's law on face masks, which states "it shall be unlawful for any person over sixteen years of age while wearing any mask, hood, or other device whereby a substantial portion of the face is hidden or covered (§18.2-422 )"

Prior the protest, the arrested activist was convicted on trumped up charges involving a fur protest. A Washington, D.C.–based judge originally sentenced the activist to nine-months in jail but suspended the sentence on condition that the activist not violate law in the next year. On account of the mask arrest, the activist may have to spend those nine months in jail.

Virginia's mask law is obscure and rarely enforced. The same weekend the arrested activist was issued an arrest warrant, three other activists were also issued arrest warrants. Those three activists are current or former students at GMU. The arrest warrants were later dropped except for the individual who was arrested on Saturday, April 12.

Please help animal rights activists at George Mason University. GMU campus police identified the activist and selectively enforced Virginia's mask law. Additionally, activists have been harassed at GMU by campus police in the last week while protesting Ringling Brothers Circus.

United-Front Protests Demand Mumia Abu-Jamal’s Immediate Freedom

All out for united-front mobilizations called by the Partisan Defense Committee under the slogans: “Mumia Abu-Jamal Is Innocent! Free Mumia Now! Abolish the Racist Death Penalty!” Oakland, Toronto and London on April 19; Sydney on April 23; Mexico City on April 24; Chicago and Los Angeles on April 26. Against the March 27 decision by the Third Circuit of Appeals, which upheld Mumia Abu-Jamal’s frame-up conviction and ordered a new sentencing hearing that would either entomb him for life in prison or reimpose the death sentence, the Partisan Defense Committee has launched an international campaign to demand Mumia’s freedom. Protests in the U.S. have been initiated by the PDC and the Labor Black Leagues, while the PDC’s fraternal defense organizations have called the international demonstrations. Mumia’s daughter, Goldii, will be speaking at the L.A. protest.

In its April 11 call for the international united-front protests, the PDC stated: “Mumia was framed up because of his lifelong struggle against racist oppression and police terror—first as a Black Panther Party spokesman, then as a MOVE supporter and an outspoken journalist renowned as the ‘voice of the voiceless.’ The cops, prosecutors and courts—with the support of capitalist politicians, Democrats and Republicans—see in Mumia the spectre of black revolt, a voice of defiant opposition to the oppression of black people that is a cornerstone of American capitalism…. It is all the more urgent today to revitalize mass protest to free Mumia on the basis that he is innocent, the victim of a racist and political frame-up, and to link his fight to the struggle to abolish the racist death penalty.”

Responding to those who viewed the decision as a victory, Mumia underlined in an April 7 radio interview on Berkeley’s KPFA that the courts have created “a new rule” to keep him behind bars. He said, “When a court has to make up new rules and make up new law to uphold something that was unjust before, that’s not a victory. It’s not a victory. But we struggle on.” Speaking of the racist rulers’ drive to silence him, Mumia stated, “For many people, especially for those in the establishment, I represent, in many ways, their greatest nightmare,” adding, “what they fear is the black revolution reigniting.” Mumia underlined: “Remember what the elder, Frederick Douglass, taught us: that power concedes nothing without a demand.” The interview can be heard at: http://www.partisandefense.org/media/Mumia-Flashpoints.mp3.

Over the last two weeks, more than 300 organizations and individuals have endorsed the united-front demonstrations. These include trade unions representing hundreds of thousands of workers, such as the International Longshoremen’s Association (ILA) Local 1422, Charleston, SC; Amalgamated Transit Union Locals 241 and 308 in Chicago; the Victorian Branch of the Maritime Union of Australia; the Aberdeen Trades Union Council in Scotland; SUD Rail Workers Union of Paris Left Bank; the Congress of South African Trade Unions (COSATU) Western Cape, which issued a statement declaring, “We will stand with the millions of people across the world that are calling for justice to be done and will join the protest against this travesty of justice.” Other endorsers include the Day-Mer Turkish and Kurdish Community Centre in London, writer Gilles Perrault in France, Cornel West, Cynthia McKinney and Professor Dr. Heinrich Fink, Chairman of the Association of the Victims of the Nazi Regime—Coalition of Anti-fascists, in Berlin. PDC counsel Rachel Wolkenstein, who served on Mumia’s legal defense from 1995 to 1999, stated: “The fight for Mumia’s freedom is at a critical juncture. The recent court decision illuminates for any who continued to have illusions in the ‘fairness’ of capitalist justice that there is no justice in the capitalist courts. Every possible legal avenue must be vigorously pursued to challenge the Court of Appeals’ decision. But we cannot afford to have any illusions. The pressure that can make the courts yield is that of mass international protest, crucially based on the power of labor. Working people around the world and all opponents of racist oppression must be mobilized in the fight to free Mumia now!”

ELP is sad to report that we are receiving more information on the American police informant Frank Ambrose. Documents seen by ELP refer to an informant CS1 who is believed to be Ambrose. CS1 has suggested to the FBI that Marie Mason was involved with both ELF and ALF activities and CS1 allowed a telephone conversation between themself and Marie Mason, in February 2008, to be bugged.

Please note the date, CS1 was cooperating with the FBI in February 2008 before Ambrose and the others were arrested.

It is also being suggested that Ambrose may have named upto 15 people to the FBI as part of his cooperation agreement.

ELP will bring you more news on this as we get it.

Jeff is serving 10 years for torching 3 SUV's to highlight the environmental damage caused by these vehicles. Despite the fact no one was ever injured or endangered by his actions Jeff was originally sentenced to over 22 years imprisonment, but happily this sentence was reduced on appeal. Eric McDavid Sentencing Set for April 17

Eric's sentencing has been reset for April 17, at 9 am (courtroom no. 7,
14th floor, Federal Courthouse at 501 I St, Sacramento). We are still
asking that people come show their support for Eric in the courtroom on
this difficult day. The government is still asking for a 20 year sentence
for Eric. If you come on the 17th, please make sure you come dressed
appropriately for court.

Also, the May issue of Elle magazine has a feature article on "Anna" - the
informant in Eric's case. It is rather informative, and has some good
interviews and previously unknown facts.

This May 1st, what some people like to call May Day, MKEtoRNC, a
group of Milwaukee area anarchists and anti-authoritarians organizing
against the upcoming Republican National Convention (RNC), will be
hosting a prison and resistance theme gallery show as a fundraiser
for those who were recently arrested in Milwaukee during an anti-war
protest and for a general prisoner and legal defense fund to support
those are currently and may also one day be entangled in and held
captive by our lovely prison industrial complex.

For resistance to be a sustained project, its material and social
support must become a sustained project as well.

Solidarity to Sara Jane Olson

The RNC Welcoming Committee and the Arise! Books and Resources Collective
would like to extend their sympathies and solidarity to former St. Paul
resident Sara Jane Olson and her family. While some call into question the
actions of the Symbionese Liberation Army, the only way to avoid criticism
is to remain silent, and so we find the words and actions of the SLA
inspirational. The everyday violence of the state, of which the murder of
several SLA members was only a part, is immense. Sara Jane Olson spent and
continues to spend her life in accordance with her conscience, bravely
resisting systems of oppression. We regard her a hero and history will as
well.

Between her involvement in the SLA and her arrest in 1999, Olson
contributed immensely to radical and progressive causes, including being a
founding member of the Arise! Books and Resources Center in south
Minneapolis. She demonstrated that the vast majority of work undertaken by
even the most militant radicals is nonviolent and community-focused,
manifesting a diversity of tactics and strategies for radical change. As a
compassionate and caring mother, wife and organizer in the Twin Cities,
she shattered the demonizing media and government stereotype of radical
activists, replacing a false impression of blind anger with an embodiment
of righteous love.

It is clear that Sara Jane Olson's re-arrest was prompted by pressure from
police unions and the political right. It is also painfully obvious that
the state never takes such action under similar pressure from the
communities most directly affected by the prison industrial complex.
Therefore, it is vitally important for the radical and progressive
community to support Sara Jane, realizing that an attack on one member of
our movement is an attack on all of us. As we in Minnesota prepare to
create our vision of resistance and direct democracy during the spectacle
of the Republican National Convention this September and beyond, we will
carry on Sara Jane's struggle and choose solidarity over divisiveness.

If there is any way our work can benefit the Olson/Peterson family, it
would be an honor.

Two Murders, Forty Years On-Bobby Hutton and Martin Luther King, Jr.

April 4, 1968 was the day that Martin Luther King, Jr. was killed in Memphis, Tennessee. He had been working with the Memphis sanitation workers in their struggle for better working conditions and a union. The night before his assassination he gave his speech that ended with the words "But I want you to know tonight, that we, as a people will get to the promised land. And I'm happy, tonight. I'm not worried about anything. I'm not fearing any man. Mine eyes have seen the glory of the coming of the Lord."

The next day he was gunned down on the balcony of the Lorraine Motel by either James Earl Ray and/or persons unknown. Although I am one of those that doubts Ray's supposed role in the murder, that is not the purpose of my writing. We will probably never know for certain exactly who conspired to kill Dr. King. We do know whose interests were served by his murder. Many of those same elements of US political and economic society that were served by King's murder continue to be responsible for much of what goes on in those arenas to this day.



No, my purpose writing today is to talk about another political murder that occurred two days after Dr. King's. This murder happened across the country in the city of Oakland, California and we know who the murderers were. The murdered man (a young man of 17, in fact) was Bobby Hutton and the murderers were members of the Oakland Police Department. Bobby was the first person to join the Black Panther Party after it was formed by Huey Newton and Bobby Seale in 1966. In a rather bitter twist his murder was also the first murder by law enforcement of a member of the Black Panther Party. By the time the Party had disappeared from the political landscape, more than thirty members had been killed by various law enforcement agencies.



As I write, the government continues its vendetta against former Party members in its attempt to murder Mumia Abu Jamal in Pennsylvania and in its prosecution of the San Francisco 8, to name but two of the better known cases involving party members that are still ongoing. In addition, several former party members languish in prisons around the country-many for crimes they did not commit.



The story around Hutton's murder is essentially this. After Dr. King's murder, dozens of cities and towns with large black populations across the United States erupted in what can best be termed as a rebellion. Police departments were quickly overwhelmed and National Guard and regular Army troops were called in to enforce order and protect property. One of the few such cities that experienced very little civil unrest was Oakland, CA.. Although the police would not admit it, much of this was due to the role the Black Panther Party played in keeping the lid on things, arguing with angry African-Americans intent on raising hell that any type of insurrectionary activity would provide the notoriously racist Oakland police with an excuse to kill as many black folks as they wanted. The Panthers spent much of the first forty-eight hours after King's murder diffusing potentially riotous situations throughout the Oakland neighborhoods where they were respected and known.




In circumstances that remain contested to this day, Hutton was murdered either after he left a basement where he and Eldridge Cleaver had hidden following an armed confrontation between the police and some Panthers who were pulled over by police in East Oakland or after he was taken into custody. Either way, he was unarmed. As Cleaver told Henry Louis Gates, Jr. in an interview that appears on the PBS show Frontline, he was told by one of the arresting officers who was at the scene in Oakland on April 6, 1968:


"So I was pulling the trigger to blow your head off, and something told me not to do it." I [Cleaver ] said, "praise the Lord." He said, "praise the Lord." He told me, "I am no longer a police officer." He said, "I have my own private security firm now." He said, "the reason that they have not been rushing you [Cleaver ] to court is because of my testimony and the testimony of 13 other police officers who were there that night who do not agree with what the police did in the way they killed Bobby Hutton." He said, "they murdered Bobby [Hutton ]. They murdered my prisoner." '

This information was relayed to Cleaver after he returned from exile and was awaiting trial on charges related to that April 1968 night. Other versions of that night claim that two carloads of Panthers were ambushed by Oakland police. In the chaos that followed the ambush, Cleaver and Hutton escaped and hid in a basement nearby. After a period of time, Hutton and Cleaver surrendered and Hutton left the building first, unarmed and without a shirt. He was then shot down in cold blood. Either way the story is told, the fact remains that Hutton was murdered by the police.



The murders of King and Hutton within two days of each other convinced many people living in the United States that forces within the US government were intent on destroying the popular struggle against racism and war by any means necessary. The historical evidence since that bloody weekend forty years ago suggests that that those forces were more successful than not.



Despite the current campaign by Barack Obama for president, the vast majority of US residents of color are not faring that much better than they were in 1968. Legal apartheid no longer exists and attitudes towards race have progressed, but the economic facts of most of non-white America are appallingly similar to their comparable state forty years ago. Furthermore the statistics regarding the imprisonment of black and Latino men in the United States provide concrete evidence that the mechanics of racial oppression continue to operate in this country. The criminal justice system continues to be the means by which the predominantly white and essentially racist power structure maintains its control over those who are poor and whose skin is darker in hue. Like I noted above, many of the same elements of US political and economic society that were served by the murder of Dr. King and the destruction of the Black Panther Party continue to be responsible for much of what goes on in those arenas to this day. No matter how one tries to portray the past forty years of this aspect of US history, it is clear that we have not reached the promised land.

Rape as an Instrument of Total War

Louise Arbour, the UN Commissioner for Human Rights, recently announced her decision to resign her position and not seek a second term. Reading behind the formal language of a well-respected diplomat, its clean the Arbour quit out of disgust with the UN's failure to seriously address the international moral crises precipitated by the Bush administration's "war on terror.
"

Arbour had a now-famous dust-up with the U.S.'s former UN representative, John Bolton, in 2006 over Israel's invasion of Lebanon. She suggested that Israeli leaders could be charged with war crimes. "You know, in America," Bolton retorted, "prosecutors are not supposed to threaten people in public based on press reports." Contemptuously, he added, "I would just say as one lawyer to another, that to Mrs. Arbour, that she should consider her professional ethics and responsibilities very carefully here before threatening criminal charges based on press accounts.
"

Arbour, the former Chief Prosecutor of the International Criminal Tribunal for the former Yugoslavia (responsible for the indictment of Slobodan Milosevic) and former Justice on Canada's Supreme Court, knows war crimes when she sees them. Clearly, she had enough of the double-speak masquerading as justice. Traditional prohibitions against war crimes, torture and, most scandalously, sexual terror against girls and women have seriously eroded over the last seven years. She had enough.

The rape of female (and occasionally male) non-combatants by male soldiers during a war is a feature of human social relations since the earliest times. The Old Testament is replete with stories of the rape of women by conquering tribes. They have long been raped and kidnapped as "spoils of war" and often forced to marry their captors to survive. The abduction of Helen of Troy remains, after two-and-a-half centuries, a testament to the consequences of male conquest.


Reported rapes of female non-combatants by U.S. soldiers in Afghanistan and Iraq appear to be limited. However, given the U.S. military's inherent secrecy and repeated cover-ups, the true story of war rape will likely not be revealed until well-after the occupation ends.


Charges of rapes of Vietnamese women by U.S. soldiers were made by Susan Brownmiller and others during the war (e.g., "Against Our Will," 1975). It wasn't until only quite recently that the full scale of confirmed atrocities by American forces in Vietnam was revealed to be more extensive than previously known. Reports in the "Toledo Blade" [October 19, 2003] and the "Los Angeles Times" [August 6, 2006] discuss more than three hundred atrocities (including rapes) that were finally substantiated by Army investigators, and this does not include the most notorious U.S. war crime, the 1968 My Lai massacre.


While incidents of rape by today's U.S. male soldiers appear relatively few in number, one cannot say the same for other military forces operating throughout the world. Conflicts in the Democratic Republic of the Congo (DRC) and Darfur, like earlier ones in Rwanda as well as Bosnia and Herzegovina, Myanmar and Somalia, were scarred by innumerable documented incidents of rape. Rape as an instrument of war was also reported in recent conflicts in Bangladesh, Cambodia, Côte d'Ivoire, Cyprus, East Timor, Haiti, Liberia, Peru and Uganda.


Rape is the most traumatic invasion one person can inflict on another. It has long been misconceived as a sex act. Although one of the most forceful physical engagements, often involving the genitals and other body parts, rape is not erotic, not sensual, not pleasurable. It is violence and terror masquerading as passion.


The inherent violence and terror of rape finds its most barbaric realization during war, especially under conditions of modern total war. The Civil War general, William Tecumseh Sherman, pioneered total war during his infamous "march to the sea" in 1864. His campaign effectively destroyed his enemy in both physical and spiritual senses; it ended America's most consequential military engagement.


Sherman believed that war should be total, that it should be extended from a conflict between recognized combatants to a conflict involving an enemy's entire society, including its natural resources, farming and food supply, utilities and other aspects of civilian life.


This shift in military strategy only got worse during the 20th century. The first and second World Wars added airplanes and toxic gases and then gas chambers, fire bombings and nuclear weapons to the arsenal of total war. This enhanced weaponry extended Sherman's model of military engagement from the destruction of the civilian infrastructure to the terrorization of the civilian population. And, in the euphemistic language the so distinguished last century's bureaucratic denial, the targeted civilian casualties of total war came to be known as "collateral damage".


A new era of warfare is underway. It differes significantly in terms of a number of the defining features of 20th century military strategy.
First, warfare today seems constrained in the deployment of vast military forces, mass armies; the first
Gulf War was a glorified police action in which a mass-mobilized "coalition" slapped down a wayward, second-rate state. Second, warfare appears restricted in the employment of the most powerful weapons available through the military-industrial complex; victory in World War I and II was predictated on the maximium deployment of the most advanced technologies of mass slaughter.


Our new era of warfare seems to be defined by contained conflicts, battles restricted to collapsed nation-states, limited in the use of advanced weaponry and rarely involving multple-state alliances mercilessly contesting one another. In this new ear of total war, collateral damage has become a legitimate target of free-fire conflict.


One consequence of this new era of military conflct is the changing role of rape. First, there has been an increase in the number of reported rapes; this increase in reflected in (a) the number of reported rapes taking place during a specfic conflict and in (b) an overall number of conflcts taking place throughout the world. Second, more militaries have adopted rape as an (unofficial) operational techique in their total war campaign. While the enemy male combatant is beaten or shot, sometimes tortured, raped or even murdered in detention, the systematic rape of girls and women appears to be an innovative and accepted technique of today's total war culture.


Fulfilling Sherman's gruesome vision, the line between the warrior and the noncombatant, the soldier and the civilian, has been formally obliterated. As this happened, warfare had but one unexploited territory to systematically plunder, the enemy's physical being, it's living body.


Adult males are plunders through torture; some boys and females of all ages are plundered through rape. For females, plunder, invasion, rape both harms and stigmatizes. Some believe that rape signifies pollution, of both the woman and the "fruits" of her conquest. Rape has become a defining feature of total war in these early years of the 21st century.

Last summer, the third U.S. soldier from Company B, First Battalion, 502nd Infantry, 101st Airborne Division, was sentenced for his part in the rape and murder of an Iraqi family in Mahmudiya, a Sunni town 20 miles south of Baghdad. As some might recall, these soldiers broke into a family home, raped the teenage Abeer Qassim al-Janabi while her parents and a 7-year-old sister were locked in a backroom, and then killed her and her family. For their crimes, the soldiers received a combined total prison sentence of over three hundred years.


This third soldier is Jesse Spielman, a 23-year-old U.S. Army private; he was sentenced to 110 years. Earlier this year, Sergeant Paul Cortez was sentenced to 90 years and, in November 2006, Specialist James Barker got a 100 year sentence. Each was found guilty of four counts of murder, rape, conspiracy to commit rape, housebreaking with the intent to commit rape and conspiracy to commit rape. In March 2007, Pfc. Bryan L. Howard, 19-years-old, pleaded guilty to monitoring radio communications and received 27 months confinement.


Steven Green, described as the ringleader, was discharged in May 2006 on psychiatric grounds apparently before the army learned of the Mahmudiya episode and is awaiting trial. Court testimony indicates the following sequence of horror: Cortez and Barker raped the girl; Green shot the parents and younger sister; he then raped the older girl, killed her and they poured kerosene on her body and set it on fire. Earlier this year, Federal prosecutors in Louisville announced their intention to seek the death penalty in Green's case.


The teenage rape victim was Abeer Qassim Hamza al-Janabi; Abeer means "fragrance of flowers". Pictures of the perpetrators show very young men who seem not only inexperienced with the ways of the world, but profoundly unprepared for the horrors of war that awaited them in Iraq. Green told a journalist: "This war is different from all the ones that our fathers and grandfathers fought. Those wars were for something. This war is for nothing.
"

On July 29, 2007, a particularly gruesome case of human slaughter took place in the Democratic Republic of the Congo (DRC). According to a UN report, a soldier in North Kivu province allegedly raped and then chopped to death a Hutu woman and her three-month-old baby.


A UN press release says the rape was emblematic of "violations by the Congolese national police and by armed rebel groups, including the murder and rape of villagers and the extortion and robbing of civilians." Yakin Ertürk, the UN Special Rapporteur on Violence against Women, denounced the sexual violence in the DRC as the worst she has ever seen.


According to the UN, 27,000 sexual assaults were reported in 2006 in South Kivu province and this is understood as just a fraction of the total number of rape casualties across the country. "The sexual violence in Congo is the worst in the world," said John Holmes, the UN's under secretary general for humanitarian affairs. "The sheer numbers, the wholesale brutality, the culture of impunity--it's appalling.
"

Other Western observers are equally shocked by what appears to be an unprecedented level of sexual violence. Malteser International, a relief agency of the Sovereign Order of Malta and working in the eastern Congo, reports that in one town, Shabunda, 70 percent of the women admitted being sexually brutalized. André Bourque, a Canadian consultant who works with aid groups in eastern Congo, warned that "sexual violence in Congo reaches a level never reached anywhere else. It is even worse than in Rwanda during the genocide.
"

Perpetrators of sexual violence include Congolese government troops, who are judged among the worst offenders. They also include the so-called Rastas, paramilitary groups who terrorize the rural countryside by kidnapping and raping women, burning babies and slaughtering anyone who challenges them. They are mostly former Hutu militias that fled Rwanda after the genocide wars of 1994 and survive deep in the forest, recognized by their dreadlocked, shiny tracksuits and Los Angeles Lakers jerseys. In addition, there are the local militias called the Mai-Mai who invoke a far older military mythology: they slick themselves with oil before marching into battle.

Since 2003, the Darfur region of western Sudan has been the site systematic terror. According to Amnesty International, "In these attacks, men are killed, women are raped and villagers are forcibly displaced from their homes which are burnt; their crops and cattle, their main means of subsistence, are burnt or looted.
" [AI, "Darfur: Rape as a weapon of war: sexual violence and its consequences," 19 July 2004]

To date, in Darfur an estimated 2.5 million people have been displaced, more than 400,000 have died and an untold number of women and girls have been raped and sexually terrorized. A 2007 report by Refugees International found that "the raping of Darfuri women is not sporadic or random, but is inexorably linked to the systematic destruction of their communities." It claims that the government-backed janjawid militiamen, the "armed men on horses or "Arab militia," practice rape as a weapon of ethnic cleansing.

Most recently, a March 2008 report by Louise Arbour found that there were "strong indications" that members of the Sudanese Armed Forces (SAF) committed rapes of women and girls in Sirba, north of West Darfur's capital, El Geneina. The report stated that one eyewitness saw "four girls being escorted to an abandoned hut and raped at gunpoint by a group of soldiers belonging to the SAF.

Two additional examples document the growing use of sexual terror on women and girls since the end of the Cold War. In Rwanda, the UN estimated that as many as 500,000 women and girls suffered brutal forms of sexual violence, including gang-rape and sexual mutilation, of which many were infected with HIV/Aids. In Bosnia, more than 40,000 Muslim women were estimated to have been raped and some impregnated girls were forced to bear "the enemy's" child. These examples suggest the increased use of rape as a technique of total warfare.

In his elegant meditation, "War Is A Force That Gives Us Meaning," Chris Hedges grasps the dehumanizing role of war:

War breaks down long-established prohibitions against
violence, destruction, and murder.
And with this often comes
the crumbling of sexual, social, and political norms as the
domination and brutality of the battlefield is carried into
personal life.
Rape, mutilation, abuse, and theft are the
natural outcome of a world in which force rules, in which
human beings are objects. ["War," p.
103]

A war can be a social revolution or an ethnic genocide, a clash of vast armies or a civil conflict. War can set people free or subject them to the worst mass vengeance. In either case long-established prohibitions, what Freud called the superego, brake down. People become other than themselves. Yet, the vengeance of war can be rationalized, focused into an accepted tactic of military doctrine.


General Sherman, who introduced total war, once observed: "We are not only fighting hostile armies, but a hostile people, and must make old and young, rich and poor, feel the hard hand of war." He urged his fellow Unionists that they must "make the war so terrible ... [and] make them [non-combatants] so sick of war that generations would pass away before they would again appeal to it.
"

Sherman developed the strategy of total war from his experience during the Second Seminole War of 1835-1842, serving under General (and future President) Zachary Taylor. He was most galled by the Native people's innovative use of mobile attacks which permitted them to quickly strike and disappear.


In the face of such unorthodox warfare, he called for the total eradication of the Seminole people. "I want you to be bold, enterprising, and at all times full of energy," he told his soldiers, "when you begin, let it be a campaign of annihilation, obliteration and complete destruction. ..." In particular, he singled out the destruction of Seminole enclaves and the indiscriminate killing of warriors; he targeted farms at harvest time and buffalo herds to eliminate the Seminole's food source.


Over the last century-and-a-half, total war has been systematically extended from food stuffs to innocent collateral victims to anyone who, in Sherman's words, is part of the "hostile people." Louise Arbour's decision to resign her UN position is testament to how Bush administration policies of total war are fostering international moral crises.


The military targeting of girls and women for sexual assault and rape has become the most extreme _expression of this crisis. Whether involving U.S. grunts in Iraq or janjawid in Darfur, rape is an instrument of total war. Rape is a form of torture, especially targeted at females. It is intended to not only inflict pain, but to shame the victim by undermining her sense of personal dignity and self-identity.


In addition to rape during total war, girls and women have been subject to increased reported incidents of forced prostitution and sex trafficking in non-war enclaves of intensifying globalization. These crimes illustrate how the scope of total war is expanding to everyday life. War is migrating from the remote battlefield to the urban downtown; from recognized conflicts between hostile armies to but another aspect of illicit commerce wrecking havoc on developing nations throughout the world. Total war is modernity's self-negation.

Mapuche Anarchist Jhonny Cariqueo Yañez died March31st, 2008 after suffering a heart attack while being beaten by the Carabineros (chilean police) during protests commemorating the Day of the Youth Combatant, in Pudahuel, Santiago. Jhonny was in the company of two comrades from the collective "Raised Fist" leaving the scene of clashes between police and protesters when a van full of special riot police intercepted them. The police beat and arrested Jhonny and his friends who were brought to the 26th Precinct in Pudahuel where they suffered constant verbal and physical assault...

Jhonny suffered from heart problems and as a consequence of the brutal beating he recieved from the Carabineros he began to have intense chest pains as well as pain in his arm. The police refused his pleas for medical attention claiming (falsely) to not have vehicles available to take him to the hospital. Finally after much insistence by his friends Jhonny was later taken to the emergency room where he was given injections to better him. He was then returned to the jail where he was beaten again, and released the next day. Monday the 31st around 2pm Jhonny laid down in his bed and had a heart attack, minutes later he was dead. The death of our compañero Jhonny Cariqueo Yañez was the consequence of his treatment by the Carabineros, and their subsequent negligence. The death of Jhonny is one more on the long list of radicals who have fallen in their fight against those who profit from our oppression. Are response will be to continue on the path that Jhonny made an effort to construct, the path of revolution, until we achieve our true liberation.

Bashir called today asking for urgent medical assistance. He has lost a lot
of weight, has diarrhea, can't sleep nights, loss of appetite; and the
authorities are refusing to let him have any medical attention.

Bashir had a triple by-pass heart operation about two years ago, so we have
to treat these symptoms very seriously. Call the prison immediately and
demand the following:
1. Bashir must receive immediate medical attention.
2. He must be taken to the hospital that did his heart operation
immediately.
3. He must be transferred immediately to a facility where his medical
needs can be taken care of.

Make a similar phone call to Assemblyman Jeffrion L Aubry, Chairman of the
Corrections Committee, Telephone # (718) 457-3615. Bashir has reached out
to Assemblyman Aubry to investigate conditions at Great Meadows
Correctional
Facility with little success.

Please follow-up your phone call with a letter to the warden of the prison
demanding immediate medical treatment for Bashir. Copy the letter to

Hi all,

I just received a letter from Michael W. Sykes. He is awaiting trial on charges in connection with some anti-development/sprawl arsons in Michigan. He is 17 years old and an anarchist. He loves nature and would like to receive books, especially ones about native Americans, environmentalism, and field guides. He said that if people write him he can send them art work and that he would also like visitors.

Welcome to the April 2008 edition of Spirit of Freedom. Over the years ELP
has sent out a number of bulletins asking our supporters to help secure raw
energy, vegan or vegetarian diets for the prisoners we support. Most of ELP
's prisoners are vegan or vegetarian and ELP recognises the importance of
helping the prisoners secure the diet they need. Therefore ELP has
introduced a new element to our prisoner lists and we have started to list
what diet a prisoner follows. For example, you'll see that the American
prisoner, Tre Arrow, is a raw energy vegan. We encourage all our supporters
to ask a prisoner, who is a vegan or a vegetarian, if they are receiving an
adequate diet? If they aren't receiving the correct food then please help
that prisoner by contacting the prison and asking, politely, that the
vegan/vegetarian prisoner is given the diet of their choice. It is
important we support the prisoners in every way we can, and making sure they
have food to eat is obviously a highly important area of our support. For
example, when American prisoner, Jonathan Paul, first went into prison he
lost a lot of weight because he wasn't receiving a correct vegan diet. So
please, no matter where you are in the world, support the eco-prisoners and
no compromise in defence of Mother Earth!

arson against a Poplar Tree Farm and an ELF arson against an SUV dealership.

Marco Camenisch, Postfach 3143, CH-8105 Regensdorf, Switzerland. Serving 18
years. 1) Ten years for using explosives to destroy electricity pylons
leading from nuclear power stations. 2) Eight years for the murder of a
Swiss Boarder Guard whilst on the run. In '02 Marco completed a 12-year
sentence in Italy for destroying electricity pylons in Italy. (Marco is a
meat eater who encourages organic living).

Silvestre activist awaiting trial accused of using explosives to damage an

years for: 1) Using a hammer to disarm a nuclear missile silo. 2) Burning
$25,000 on the floor of a bank whilst denouncing war, environmental

THE LECCE FIVE
The Lecce Five have been charged with "subversive association" accused of
damaging Esso petrol pumps to oppose the War on Iraq; sabotaging the cash
machines of a bank which funds an immigration centre; and targeting the
multinational company Benetton in support of Mapuche land rights activists
in Chile. All of the defendants are currently either under house arrest or
released on bail.

His charge was "bodily harm". He speaks Czech, Slovak and Polish. You can

Serving 15 years for accidentally killing a neo-nazi whilst defending

140090 Moskovskaya oblast, Russia. Eco-activist serving 6 years for arson,
criminal damage and causing explosions in protest at the war in Chechnya.
Due for release in 2009. (Diet unknown).

Vaggelis Botzatzis, Komotini Juridical Prison ("Dikastikes Fylakes
Komotinis"), T.K. 69100, Greece. On remand accused of setting fire to two
company cars owned by a energy/power company. It is believed that the
person or persons unknown who carried out the arson did so in protest at the
destruction of the natural environment and in support of two workers who
died at the power plant. Vaggelis is also accused of setting fire to a bank
and starting a fire inside a car yard. (Meat Eater).

Maura Michlle Lungarlli, booking # 1167062, Century Regional Detention
Facility (CRDF), 11705 South Alameda Street, Lynwood, CA 90262, USA. Well
known animal rights activist Laura Michelle Lungarlli serving one year
imprisonment for activity unconnected to animal rights. (Please note the
prison officials have made spelling mistakes with her name, these mistakes
must be replicated on her letters of support - Laura is a vegan).

Kevin Olliff, booking #1167029, Terminal Annex, P.O. Box #86164,
Los Angeles, CA 90086-0164, USA. Animal rights activist jailed for 16
months for activity unconnected to animal rights. Co-defendant of Laura
Lungarlli (Kevin is a vegan).

on remand accused of anti-sprawl arsons, criminal damage, spray-painting an

MOVE
MOVE is an eco-revolutionary group who carried out protests in defence of
all life. All move prisoners describe themselves as vegetarians. There are
currently eight MOVE activists in prison each serving 100 years after been
framed for the murder of a cop in 1979. 9th defendant, Merle Africa, died
in prison in 1998.

William 'Lefty' Gilday needs your support!

Greetings all,
I am writing to inform you all that U.S. political prisoner, William
'Lefty' Gilday recently spent 13 days in the hospital after suffering a
silent stroke on his left side. Lefty wrote this week to inform us that
he is back in the medical unit at MCI Shirley, but that he is still in
bad shape. He can't walk, and can barely get out of bed. Lefty says the
prognosis is good, but your letters of support and get well cards can
help raise his spirits and maybe effect the healing process. Please take
a moment out of your day to write to Lefty. He needs your solidarity now

Avelino González . . . A Tireless Fighter

In August of 1985, Avelino González, along with other Puerto Ricans and 2 North Americans, were accused of having participated in the planning and authorization of an operation to secure $7,117,000.00 from a Wells Fargo armored truck in Hartford, Connecticut on September 12, 1983. That operation was carried out by the then PRTP-Macheteros. They are accused of being part of the Central Committee and Political Commission of the PRTP-Macheteros. Avelino, his brother Norberto and Victor Gerena, the main person accused, could not be arrested at that time. Norberto and Victor remain underground to this day.

The charges against those arrested that year ended in a trial of a group of the accused (Carlos Ayes, Filiberto Ojeda, Juan Segarra, Norman Ramirez and Roberto Maldonado) in 1989 and finally led to a political-legal agreement in 1992 with the accused Orlando González, Hilton Fernández Diamante, Jorge A. Farinacci, Isaac Camacho, Elías Castro and Angel Días Ruiz and later led to another trial of the accused Ivone Meléndez Carrión. The legal agreement reached recognized the Macheteros as a political organization that fights for the independence of their homeland.

Avelino was born in the town of Vega Baja on October 8, 1942. Since his days as a student in the public schools of his country he established himself as a fighter for the freedom of his homeland. Upon entering the University of Puerto Rico he became a member of the Pro-Independence University Federation (Federación Universitaria Pro Independencia –FUPI), a student organization founded in 1956 that has stood out for its struggle for university reforms to improve conditions at the university for our people. Avelino became its vice-president. Avelino stood out as one of its best militants and as a person for whom no task was too small or too big to take on.

Since becoming a student he embraced socialist ideas as his own, becoming a constant student of the history of our working people and their struggles, as well as, studying the socialist ideological classics. He always stood out for his knowledge of the history of the workers’ international struggles and their revolutions.

He married in the mid-1960’s and had 4 children who today are part of the professional classes of our country. At that time he moved to New York City where he lived until the beginning of the 1970’s. He worked in Wall Street in that city while he carried out political work with the Puerto Rican community and organized part of the resistance of the revolutionary forces that were beginning to organize themselves in “the belly of the Yankee beast” and had begun to stand out by the end of the 1960’s. Avelino became part of the leadership of the Vito Marco Antonio Mission of the Movemento Pro-Independence (MPI) in New York.

Avelino returned to his homeland to integrate into the political work where he stands out as one of its most capable and disciplined leaders. At the time of the arrests in 1985 he was known for his role in the administration of the operations of the political magazine Pensamiento Crítico (Critical Thought). It is at that time that he becomes one of the Puerto Ricans most sought by the enemy and he transforms himself into the citizen José Ortega.

Upon getting to know Avelino as one of the leaders most committed with his ideas of freedom for our homeland and the program of struggle of his organization, we do not doubt that he has been in the heart of our people, struggling alongside them for their civil rights to freedom and social justice for its working classes. Many have been the trenches of struggle of this well-known leader and militant of the revolutionary struggles of our people and its movement for national liberation for the past 50 years.

Following the arrests of August 30, 1985, Avelino became part of the struggles of our people as “José Ortega”. For the past 22 years he alluded the enemy and was able to participate not only in the struggle for our peoples liberation but also as a worker and computer teacher where he realized work for the improvement of the services provided by the Department of Education of Puerto Rico.

Avelino is known for his calm tolerant manner but at the same time for his firmness in the _expression of his positions and political ideas. For him there is no room for hypocrisy when it’s time to combat ideas that he considers incorrect. His personality, his demeanor and his ideas regarding the necessity for unity in the liberation movement led him to always espouse that differences should not be a motive for divisions. He has never been heard to make mean-spirited or derogatory accusations of those he has political differences, either in his organization or toward those outside it with whom he has differences because of their political practice or strategy. He said in his first communication after his arrest, “ . . . Pandora left desperation out of her box and because of this they may chain and imprison my body, but never my spirit and my ideas”

Avelino today finds himself incarcerated in a state prison in the city of Hartford in conditions of “maximum security”. 23 hours in isolation in a jail cell, with one hour to get fresh air, with no access to his family and denied communication by telephone with his family members, his lawyers or friends. They propose to judge him, as they have his comrades in struggle, faraway from his Puerto Rican homeland.

The U.S. government must recognize Avelino’s status as a fighter for independence and a political prisoner, as he demanded in its imperial courts!

We know that Avelino is man in very good health at the time of his arrest and we hope that he remains so. Any change in his health condition will be the responsibility of his enemy jailers.
